Research On Disputes Resolution Of Urban Community Based On People's Mediation Law

People's mediation as a dispute resolution method rooted in the Grass-roots society of China has played the role of inheriting traditional legal culture,building diversified dispute resolution mechanisms,and making up for the lack of legal system.People's Mediation Law of People's Republic of China(hereinafter referred to as People's Mediation Law),which was implemented in January 1,2011,has opened a new starting point for the legalization of people's mediation.It clarifies the legal status of people's mediation,straightens out the relationship between people's mediation and judicial administrative organs,courts and local governments,standardizes people's mediation procedures and agreements,thus promoting the modern transformation of people's mediation.In order to improve the resolution of urban community disputes,through empirical research,studies the current situation of community disputes in Xixinlou Community Guye District Tangshan City,and systematically analyzes the dissolving situation of urban community disputes under the guidance of People's Mediation Law,and puts forward specific measures to make up for the problems found in the investigation.Through the investigation of the sample community,find that although the cases' number of people's mediation is limited,it has advantages of convenience,low cost and good social effect.Meanwhile there are also problems in the following aspects: the first,“the people's mediation and administrative mediation and judicial litigation coordination mechanism”,“the people's mediation funding safeguard mechanism”,“the people's mediation business guidance mechanism of the court ”operate difficult;the second,professional legal knowledge of people's mediators need to be improved;the third,the recognition degree of some residents about people's mediation is not high,people's mediation to resolve disputes is not fully functional.In response to the above problems,perfecting disputes resolution of urban community should integrate disputes resolution resources,build the internal and external coordination mechanism of people's mediation;strengthen the construction of people's mediators,establish a long-term mechanism of rewards and punishments;improve the residents' understanding of the effectiveness of the mediation agreement,promote the authority of the people's mediation;adhere to the correct guidance of public opinion,carry forward the idea of resolving disputes in the new era.
