Research On Legalization Of Social Evaluation Of Water Project Resettlement

Resettlement of water project,namely resettlement of water conservancy and hydropower engineering,is an involuntary resettlement led by the government.Resettlement policy is an important measure for regulating the interest among of resettlement in water project.The social assessment is the major tool to realize the goal of this project.In recent years,the quantity of resettlement programmes is increasing,and its scope and scale are getting larger.The State Council promulgated a regulation named Regulations on land requisition compensation and resettlement for large and medium-sized water conservancy and hydropower projects(No.471 st of the State Council Decree)in July,2006.It made clear provisions of the standard of compensation for land expropriation and resettlement procedures in resettlement of water project.Social assessment of water project resettlement is the main measure to enhance the degree of satisfaction of the land expropriation and resettlement work.In terms of technology,social assessment should not only reflect the public objectives of water project,but also fulfill the basic requirements of resettlement.The social satisfaction is a major standard to measure the effect of resettlement within a certain period,which has a fundamental impact on the impartial and objective social assessment results.Decision of the State Council on Amending the regulations on land requisition compensation and resettlement for large and medium-sized water conservancy and hydropower projects(No.679 th of the State Council Decree)was promulgated in 2017.It pointed out that the standards of land requisition compensation and resettlement allowance for large and medium-sized water projects construction should be the same as those infrastructure projects such as railway construction projects.In fact,each of the resettlement projects has an established performance objective,but it is not easy to achieve the performance objective of water project resettlement in practice.How to measure whether the performance objective of water project resettlement is realized or not? How about the degree of realization? What issues exist? What is the real reason behind it? How to improve the water project resettlement policy? That is the core issue which should be focused on in this article.Based on empirical analysis of three water projects of resettlement(reservoir resettlement in L,reservoir resettlement in G,hydropower resettlement in Q)in China.The results show that implementation degree of policy objectives are deviated from expectations.There are a series of issues,such as lack of legal basis for resettlement definition,resettlement cycle is long,policy updates quickly and so on.The reasons include many aspects,such as the insufficient laws and regulations of water project resettlement,the narrow cognition of risk assessment,the formalistic performance objectives,the absence of the responsibility by competent authorities and the low policy support.Differ from social stability risk assessment,social assessment of water project resettlement takes resettlement and resettlement management as targets.It not only inspects the risk of resettlement projects,but also focuses on the science and democracy of the resettlement arrangement plan.Based on the land requisition compensation with the same price in the direction of reform,the social assessment system of water project resettlement should be established to improve the credibility of government decision-making.Under the realistic conditions,promoting the legalization of social assessment system of water project resettlement is a viable means of preventing performance objectives of water project resettlement from aliasing.
