Research On International Law Of IS

With the rapid rise and expansion of the "Islamic State"(IS),the threat to the world is spreading.This article focuses on the rise of IS in international law:First,it compares IS with the traditional countries in the main body of international law.It explains that although IS has the symbol of "state",it has no ability to establish diplomatic relations with other countries,and can not become a country in the main body of international law.Secondly,the similarities and differences between IS and traditional terrorist organizations in international law are analyzed.It is concluded that it is a terrorist organization not only having the characteristics of ordinary terrorism but also having its own characteristics and extremist colors,and finally positioning IS in the international community.Then lead to the core part of the article,from the two core contents of international humanitarian law and national counter-terrorism convention to study the regulation of the existing international law on IS.The theories involved include the analysis of the types of armed conflicts and the principles of international punishment.It is concluded that IS should belong to the necessity of non international armed conflicts and the use of force to fight IS and the exercise rules of the right to fight against terrorism.According to the current situation and development trend of IS,which has been "country" but the threat still exists,the fight against the terrorist organization is still a long-term strategic task,explore a set of comprehensive laws and regulations against extremist terrorist organizations the international community urgently needed,but also to combat and prevent the combination strategy,strengthen the native countries the extremists blow,and in the coordination of the UN under the construction of effective international cooperation mechanisms.At last,the article expounds the direct and indirect effects of IS on China in recent years.It is concluded that the Anti Terrorism Law of People's Republic of China,which has just been published for two years,is no longer suitable for the new form of terrorism.According to the current law in anti-terrorism legislation limitations and shortcomings,put forward suggestions for improvement and strengthening,and actively respond to the threat of terrorist forces,to establish long-term early warning mechanism,strengthen cooperation with neighboring countries and multilateral exchanges and cooperation,better eradication of extreme threat of terrorism.
