| The deepening of judicial openness is the important content of comprehensive advancement of ruling by law put forward by the Party Central Committee and is the intrinsic requirement of ensuring the judicial justice and improving the judicial credibility.At present,the legal demand of the masses is more diverse,the requirement and expectation for judicial openness are higher,and the requirement for participating in the judicial activities is more urgent.Meanwhile,the mature development of new media technology,especially the widespread use of social media represented by the microblog and WeChat,creates the convenient propagation condition for the judicial openness.Therefore,it is an inevitable choice to carry out the trail live with the help of the new media,especially microblog platform.The microblog trail live is the emerging thing in recent years.Though the time is short,its influence is overturning.The court more carried out the procedural announcement of the cases to which the masses pay close attention in virtue of the micro-blogging site in the past,and the trail live in the true sense started from microblog live of Bo Xilai case in 2013.More than 70 long image-texts with 160,000 characters first really represented the trial confrontation in writing,and its great openness degree and rich details shocked the world.Later,the Supreme People's Court actively promoted the judicial openness construction.As of Dec.2014,more than 90%of courts registered a microblog account,four-level court microblog system was established,and the microblog trail live also was normalized.Meanwhile,Sina invested in the expansion of Xinshiyun which is the professional technical team in the court industry,opened up the operation of Sina court channel with it as the subject and became the first commercial company getting involved in this field.In the end of Sep.2016,Chinacourt and Sina.com jointly opened "Chinese court trial openness network",and more than 500 courts accessed to it.It became the official platform of realizing the uniform live display of court trial video across the country,and the "national team" of trail live was established officially.Previously,Sina microblog has been the important platform of various courts to promote the trail live and collect the public opinion information.This paper selects the related data of trail live of two typical cases-Qvod case and Yu Huan case carried out in virtue of the microblog platform in recent 3 years,analyzes their propagation effect,and explores what kind of role of the new media trial live in safeguarding the right to know of the masses as well as improving the social legal sense,what is the difference among the masses in the channel of acquiring trail live and acceptability,whether the live personnel participate in the screening of live contents with the image of guard as well how the effect is,and which aspects shall be improved and perfected,etc.Since there is no related study before,it is the innovation point of this paper and provides a certain reference for the substantiation of court trial and practice of judicial openness.This paper makes an analysis from the following several questions:1.Organization of evolution of trail live way and means:From TV live and website live to microblog and WeChat client;From procedural announcement and live streaming with photos and words to live video;From single dispersed watch to internet users' open comment,then to bidirectional interaction between court and network user,and comprehensive summary and review of the gradually open process.2.Attitude of live subject(court)towards trail live:Including resource preparation,openness degree,times of live,feedback or not,etc.It directly influences the receiver's mastery degree of the information.3.Selection of the openness degree of the live:This paper studies and judges whether the court's behavior receives some influence as the guard and whether the network users' information acceptance is influenced despite the whole-process uninterrupted video playing or selective openness of image-text and short video of the microblog trail live through the analysis of typical cases.4.Analysis of trail live:This paper selects two cases producing a great influence since 2016-2017;This paper compares and analyzes the data about the case of Shenzhen Qvod Technology Co.,Ltd.being suspected of spreading obscene goods for profit-making and Yu Huan intentional injury case,studies whether the law popularization or other effect expected by the court has been realized,the masses'right to know is fully safeguarded,and the social legal sense is enhanced.5.Media evaluation and interaction effect formed by network users' opinions:Media advice and opinions about trail live and effect formed by network users'opinions,change of network users' comment tendency. |
