Study On The Legal Issues Of "Green Trademark"

Green trademark is a kind of certification mark which proves that a product or service has a specific quality to the public.Green trademark is a visual sign that uses the green or blue as the body color.The product of producer or service provider uses it on the green product.Green products are general designation of those products which are environmentally friendly,energy saving,water saving,recycling,low carbon,renewable,organic.They are harmless to human or the harm is very small and the public can use them with no worry.Green trademark has the characteristics of environmental friendliness,authority and technology.The establishment of green trademark is beneficial to guide green consumption,establish a unified green product mark system and develop green economy.At present,the standard system of green trademark has not been formed,and the certification system of green trademark is imperfect.Besides,the use of green trademark is not standardized,and the supervision system of green trademark is not perfect.Considering the legal problems of establishing green trademark in China,we can take reference to the experience of the foreign green trademark system and establish the standard system of green trademark,set up the "Regulations on the Management of Green Trademark" and meanwhile improve the transparency of the standard-setting process.Furthermore,the certification system of green trademark is to be improved from three aspects,including certification body,certification effect and certification standard.The management of green trademark institution is to be strengthened and the effect of official certification and private certification is to be clarified.We should improve the supervision system of green trademark,exert the supervisory function of non-governmental organizations,and enhance the public and enterprise's supervision consciousness.
