Judges' performance evaluation is one of the important issues in judicial reform.The main body of the court is judges.How to evaluate the judges' performance,is the key to strengthening trial management,improving trial quality and stimulating judges' self-accountability.Under the background of big data era,evaluating the judges' performance on the quantity view,can improve the public's recognition about judges' work,and it also ensure that judges can find his own problems and improve them in time.The prominent feature of the trial work is its strong procedural,professional and neutral nature,which determines that the evaluation of the trial work can not be added piece by piece simply,but also can not be artificially complicated.we should pay attention to the various elements of the trial process,the judge's creative justice and the other aspects,comprehensive investigation to evaluate and stimulate.Which will evoke the human capacity for good,and ultimately promote the judges' professionalization,and regularization.Based on the current context,the paper firstly uses the literature method and comparative method,to clarifies the concept and content of the performance evaluation of judges,demonstrates the necessity of evaluation,and introduces the practices of foreign countries on the performance evaluation of judges.And then we takes s city intermediate court as an example,from the empirical point of view,analyzes the system of performance evaluation and the deviation in the implementation process,and restores the current performance evaluation of the judges of the Intermediate Court.Last we puts forward that the feasible way to evaluate the performance of intermediate court judges is to reconstruct it.First,the reconstruction of cognition,such as establishing professional thinking,highlighting the status of judges,clarifying the role of case performance evaluation in performance evaluation,from the past to focus on the results of the process,and so on.The second is the reconstruction of evaluation content and index system.It creatively puts forward the standard coefficient of case difficulty coefficient and creative judicial evaluation content,designs evaluation indexes of case handling quantity,quality,efficiency and effect,clarifies the counting rules and exceptions of indexes,and expounds the practical significance of reconstruction of evaluation index system.The third discusses the procedural guarantee of the evaluation implementation mechanism and puts forward some suggestions on the index data centralization,the feedback of evaluation results,the procedural relief of objections,and the full use of evaluation results.
