Countermeasures For Vertical Management Reform Of Environmental Protection Institutions In Hebei Province

Vertical management of environmental protection institutions has been a long-awaited and appealed reform of environmental management system.Vertical management of environmental protection institutions will improve the problems of serious local protectionism and weak effectiveness of environmental law enforcement in territorial management.It is conducive to strengthening the authority,unity and effectiveness of environmental law enforcement,improving environmental quality and improving the efficiency of environmental management.But at the same time,there are still many problems to be solved in vertical management of environmental protection institutions.Vertical Management Reform of Environmental Protection Institutions in Full Name "Vertical Management Reform of Monitoring,Supervision and Law Enforcement of Environmental Protection Institutions under the Provincial Level"mainly refers to the supervision and supervision institutions directly administered by the provincial environmental protection departments in cities(prefectures)and counties,which bear their personnel and working expenses,and the municipal(prefectural)environmental protection bureaus implement a dual management system with the provincial environmental protection bureaus(bureaus)The bureau is no longer solely set up,but serves as the dispatched agency of the environmental protection bureau at the cause the problem of weak long-distance supervision of the general team,resulting in corruption and other problems within the environmental protection law enforcement team.After the implementation of the vertical management of environmental protection institutions,the old problems have been solved and new contradictions have emerged,such as the mutual transfer of environmental responsibility and rent-seeking of environmental protection power.In a word,these contradictions in the vertical management reform of environmental protection institutions are mainly caused by the inadequate implementation of the environmental responsibility system,the contradiction between sections,and the imperfect supervision mechanism.Based on the analysis of the above problems and consideration of the status quo,this paper,through the literature review method,draw lessons from foreign advanced environmental management experience,direct or indirect to the problems of vertical management reform of environmental protection institutions put forward solutions for reference.Hebei Province is the first pilot province to implement the vertical management reform of environmental protection institutions in China.At present,the reform has been completed and Hebei experience has been formed in practical work.Although the vertical management reform of environmental protection institutions in Hebei has made certain achievements,there are still some problems.This paper mainly studies the problems existing in the vertical management reform of Hebei environmental protection institutions,and analyzes the problems,digs deep into the reasons for the inadequate reform,and puts forward suggestions and Countermeasures for these problems.This article mainly puts forward countermeasures from three aspects:first,improve the responsibility system of environmental protection.First of all,through the detailed list of environmental responsibility to achieve the division of responsibility of the main body of environmental responsibility,so that the main body of environmental responsibility clearly their environmental responsibility;secondly,strictly implement the assessment mechanism of environmental responsibility,through a strict assessment mechanism of environmental responsibility to ensure that the list of environmental responsibility can be landed.Second,establish and improve the environmental monitoring mechanism.This paper holds that the vertical management reform of Hebei environmental protection institutions should strengthen the construction of supervision mechanism both inside and outside the system.As far as the system is concerned,Hebei should improve the environmental protection supervision system as soon as possible,and take environmental protection supervision as an important system setting for the daily supervision of environmental protection;as far as the system is concerned,Hebei should promote public participation and the exertion of social organizations.Third,straighten out the relationship between them.The contradiction still exists,which is an important reason why Hebei's reform is not yet in place.Hebei should clarify the responsibilities of various departments in the vertical management reform of environmental protection institutions through the reform of the Ministry system,and promote all parties to fulfill their responsibilities through the establishment of a legal system.This paper tries to put forward reform countermeasures for the vertical management reform of Hebei environmental protection institutions from the above three aspects,in order to solve the problem of vertical management reform of Hebei environmental protection institutions and improve the implementation effect of vertical management reform of environmental protection institutions.
