In big data era,the technology of data collection,usage and mining maximizes the economic value of personal information.Driven by economic interests,there are frequently a large of personal information infringement cases.In big data era,anonymization,fuzzification and other methods cannot play a substantive role.The existing legal protection modes are not valid.At this point,we need to generate a new right to respond to the demands of reality.Consumers' personal information is a kind of interests,which is scarce and can be expected.And in big data era,consumers'personal information has the danger of urgency,which fits the generation logic of a new right.Therefore,the personal formation right of consumers could make a reasonable and comprehensive protection.The legal attribute of personal information right,and right boundary needs to be researched.In China,the right of consumers'personal information faces a dilemma of the legislation and justice.In order to solve the problem,we should formulate specific legislation of personal information protection law,perfect the "Consumer Protection Law",enact relevant administrative rules and regulations,introduce the self-discipline norms.Besides,introducing the reversion of burden of proof,punitive damages system and of collective action is needed.
