With the rapid development of the economy and technology,the network has brought about tremendous changes to the advertising industry.Merchants are welcoming the historical opportunity to publish their own ads.Due to the high cost performance of network advertising,limited geographical time and simple production,online advertising has developed rapidly and become the most advantageous form of advertising today.The ensuing violations have also emerged endlessly.On September 1,2016,the Interim Measures for the Administration of Internet Advertising was implemented.In the period after the implementation of the law,the online advertising industry has been regulated,but grassroots law enforcement personnel still face greater difficulties and challenges in the actual law enforcement.On the network platform,misleading consumers,fraudulent consumers and other false advertising phenomena can be seen everywhere,seriously undermining the economic market operation order,damaging the consumers' own interests,and adversely affecting economic development.In order to create a benign development environment for Internet advertising and promote the sustainable development of Internet advertising,China must establish and improve the supervision system of false advertising in China's network from the actual situation of online advertising.The article mainly consists of four parts.The first part mainly analyzes the specific meaning of online advertising from the definition of online advertising,and combines the viewpoints of academic circles to explain the concept of false advertising on the network,and expounds that the false advertising in the network has difficulty in identification and various forms.Limited by geographical time constraints.At the same time,it discusses the necessity of legal regulation of false advertising on the network from the perspective of maintaining network development and protecting consumer rights.The second part is to explain the current situation of China's legislation at present,and introduce the case to propose problems in the legislative and regulatory system,such as:low legislative level and lack of content,lack of industry self-discipline,and unclear regulatory responsibilities.The third part is about the present situation of legislation,law enforcement and industry self-discipline in the United States,Japan and France.It summarizes the relatively advanced experience and combines the national conditions of China to reflect on my enlightenment.The fourth part is to give corresponding feasibility suggestions for the problems raised in the second part,including:improving the legal system,clarifying the responsibility of network information service providers,strengthening the joint law enforcement ability,and strengthening the industry self-discipline,thus forming a reasonable and effective management mode.The last part is the conclusion.
