Research On The Scope Of Active Disclosure Of Government Information

According to the regulations of our country,there are two ways to open government information voluntarily and according to application.As opposed to open according to application,active disclosure has unique institutional value such as initiative,timeliness and convenience.But in the field of active disclosure of government information,although the number of legislative provisions is large and the content of the provisions is extensive,the implementation results are not good,and the problems highlighted by them are becoming more and more serious.These issues include:careless legislation,resulting in difficulties in understanding;ineffective legislation,resulting in public access to government information in a timely manner;lack of legislation,resulting in the public having to use only those who have been made public upon application The redundancy of legislation increases the cost of information disclosure and affects administrative efficiency.On the one hand,the above problems in the active disclosure of government information affect the realization of the value of the active disclosure system,but also lead to the occurrence of a large number of cases of government information disclosure to a certain extent.The imbalance between the required disclosure on request and the active disclosure.Based on the investigation of the current legislative norms of active disclosure and the combing of a large number of cases of government information disclosure in practice,this paper examines some defects in the current legislation.The final return to the legislative provisions itself,the above-mentioned problems given a corresponding solution.Specific measures include:refinement of the original provisions too careless,improve The clarity of the regulations;strengthening the supervision of the administrative organs to fulfill the obligation to actively open government information,enhance the enforcement of the provisions;supplement the need to actively focus on the disclosure of matters,in order to reduce the relevant areas according to the application for disclosure of matters;Remove redundant regulations,save the cost of information disclosure and improve administrative efficiency.Finally,this paper also gives an exploratory scheme for the adjustment of the legislative structure and the adjusted provisions of the regulations.
