On The Research Of The Right To Information Act In India

The Right to Information Act in India is in the forefront of the information disclosure legislation,and has established a perfect system of information disclosure.In the construction of the information disclosure system,the "Information Rights Law" stipulates three basic systems,including the information disclosure system,the information committee system and the rights relief system.In the information disclosure system,the Act defines “information” and “information right”,and clarifies the diversity of forms and sources of “information”.The “right to information” includes access rights,excerpt rights,sample access rights and copy rights.In the information disclosure exemption,the bill establishes three basic principles of public interest priority,time limit exemption and severability.At the same time,the scope of the obligations of the bill is very broad,even including political parties and private entities performing public functions.In the information committee system,an information committee with quasi-judicial nature is established as an independent body for information rights supervision and rights relief,and has the power to judge,the right to punish,the power of supervision and the power to investigate.The decision,which information committee has made,is final award.However,it should be subject to the judicial review of the Supreme Court and the High Court.In the rights remedy system,the Act establishes two levels of rights relief agencies and two types of relief.In this way,the two-level relief agencies are the FAA for internal relief and the information committee with external relief,and the two relief methods are complaints and appeals.Based on the Act,a complete information disclosure system was constructed.In the implementation process,the Act improved the transparency of Indian social information and improved the establishment of relevant supporting measures.At the same time,the Act has advanced legislative experience,established the core position of the law in the legal system of information disclosure,and constructed a three-level rights protection system of "public information officer-FAA-information committee",which conformed to international information.In the trend of power legislation,China should learn from experience and constantly improve the legislation on domestic information disclosure.
