Research On Legal Liability Of Campus Bullying

Campus security is the bottom line of running a school and the basis of high-quality development of education.In recent years,with the widespread popularity of the Internet,more and more campus bullying incidents have been exposed.The number of bullying on campus and the cruelty of behavior are shocking,which has aroused great attention of the public and the media.The frequent occurrence of campus bullying not only causes long-term and indelible harm to the victim's body and mind,but also affecting the normal learning state and living environment of school students,it is easy to cause campus panic and is a social cancer.The most significant long-term persistent and hidden characteristics of campus bullying make it difficult for people to remedy its serious impact when they find it.At present,there is no special legislative document in the field of anti-campus bullying in China,but the legislative process of "Campus Security Law" has been accelerated.However,in order to deal with the problem of campus bullying,our government has promulgated six normative documents one after another(Notice on Special Management of Campus Bullying,Guidelines on Preventing Bullying and Violence among Primary and Secondary School Students,Strengthening the Comprehensive Management Program of Bullying for Primary and Secondary School Students,Notice on the Implementation of the Annual Action to Prevent and Control Bullying among Primary and Secondary School Students,etc.).When dealing with campus bullying or investigating the corresponding legal responsibility of relevant personnel,none of these normative documents are operable of application,so we can only pursue the responsibility by dispersing the provisions of different laws.This is not conducive to punishing the perpetrators of bullying and other responsible personnel,but also to providing timely and effective relief for the personal rights and educational rights of bullied students.The lag of legislation on the legal liability of campus bullying is closely related to the lack of theoretical research on the legal liability of campus bullying.Therefore,in the absence of legislation and related theoretical research in the field of legal liability for campus bullying,it is particularly urgent and important to study the legal liability of campus bullying in depth.Judging from the existing relevant legal provisions,the legal consequences of bullies and related responsible persons are administrative liability,civil liability and criminal liability,and the three major legal consequences are difficult to apply whendealing with campus bullying.Therefore,we must combine our national conditions,in-depth study of the legal liability of campus bullying related issues,learn from the beneficial experience of the investigation of legal liability for campus bullying in foreign countries,clarify the subject of legal relationship and its legal liability in campus bullying as soon as possible,promote our anti-campus bullying legislation,and promote the rule of law in education.
