Research On The Legal Issues Of Campus Bullying

There have been a lot of achievements in the research of campus bullying in our country.Most of these achievements achieve the purpose of campus bullying research through theoretical analysis and comparative research.However,the basic theoretical concept,theoretical characteristics and relevant system construction of campus bullying have been studied to a certain extent.What is relatively lacking now is a further analysis of the campus bullying in the actual legal practice,and a comparative analysis of its performance characteristics and results of legal norms with the existing theories of campus bullying,so as to further regulate campus bullying Put forward relevant suggestions.In our country’s legal practice,there are quite a lot of judicial documents have been involved in the campus bullying related issues.Based on the analysis of 113 judicial documents in recent years,the author finds that there are four characteristics of campus bullying in judicial documents.The four characteristics are as follows:campus bullying as evidence,campus bullying as fact finding,campus bullying as responsibility and campus bullying as value judgment.After the theoretical analysis of the four characteristics one by one,the complex characteristics of campus bullying will be effectively combed,so as to provide new ideas for further analysis of campus bullying behavior,campus bullying responsibility and relevant legislation.The behavior and psychological characteristics of bully and bullied in campus bullying are special,such as the weak attack power of bullying,the multiplicity of bullying,the inadequate rationality of bullying,the weak defense power of bullied,the psychological trauma that is easy to be ignored,etc.It is further demonstrated that individual power behavior is the essential characteristic of bullying behavior on campus,and tool abuse is the basic manifestation of bullying behavior on campus.Through the analysis of the special identity of minors,social expectation,and the dilemma of law prevention,this paper demonstrates that directly reducing the standard of criminal responsibility to regulate the dilemma of bullying on campus.Finally,this paper analyzes the current laws and regulations related to campus bullying one by one,so as to provide support and suggestions for the demonstration of the necessity of anti campus bullying legislation.
