Try To Talk About The Our Country The Current Situation Of Production Safety Administration Accountability And Improvement

In recent years,the administrative accountability system has been a hot topic in China's political system reform.Accountability embodies the basic principle of administrative law,that is,the right to have responsibility and the right to be supervised.As a new means of investigating illegal liability,the administrative accountability system has played an important role in the implementation of administrative supervision duties as soon as it was introduced,conforming to the times of development,and has been highly valued by the party and state leaders.However,as a new system,the development of our country is not perfect,there are many problems to be solved.From the perspective of the field of safety production,this paper holds that the provisions of administrative accountability system in this field are scattered in some laws and regulations,lacking of systematization.From the realistic level,there are still many practical obstacles to the implementation of administrative accountability system in the field of safety production,such as the situation that the implementation is not in place.Based on the concept of administrative accountability system,this paper mainly introduces the understanding of different scholars about the concept of administrative accountability system in our country.Under the premise of clear definition,the scope of administrative accountability system is further extended to the field of safety production.According to the relevant provisions in the current laws and regulations of our country and the problems existing in practice,this paper analyzes the current legislation and implementation situation of the administrative accountability system in the field of safety production.Define the concept of administrative accountability for safety production.After combing the current development process and present situation of the administrative accountability system of safety production in our country,on this basis,try to interpret the current legislative situation of the administrative accountability law from three aspects: law,administrative regulation and local regulation;From the safety production accident responsibility investigation and the administration law enforcement illegal,the fault responsibility investigation two aspects grasps the safety production administrative accountability implementation present situation.Then it points out the problems existing in the administrative accountability system of safety production at present,that is,the problems in legislation and practical operation,including the lack of legal basis,the low effectiveness of relevant laws and regulations and documents,and the emphasis on accountability and political responsibility.The standard of accountability is not uniform,the scope of actual accountability is too narrow,the administrative accountability lacks the necessary remedies,and deeply analyzed the causes of the problem of administrative responsibility system in safety production.On the basis of the reason,according to the principle of combining theory with practice,the author puts forward some reasonable suggestions on the level of legal system and practical operation,including further clarifying the object of accountability,establishing and improving the system of administrative accountability laws and regulations in safety production.I hope that these constructive suggestions can provide guiding ideas to improve the problems in practice.
