Safety In The Production Of Administrative Accountability System And Countermeasures Research

The strict implementation of administrative accountability towards safety work is not only very important to put responsibility into effect, keep extremely serious accidents within limits, realize the safety during the production and perfect safety work legal system, but also necessary to bring responsibility, law and democracy to government. Recently, there happened extremely serious accidents in safety work in China, the system of administrative responsibility was run and those corresponding officials were punished. This system deserves praised comment. However, there exists insufficiency by analyze the problems existed in the implement of administrative accountability: i.e., the regulations level is rather low in the law and its theory of law is insufficient; the accountability scope is not clear and the unified standard lacks; the principal part of accountability is short of motivity, and the responsibility of accountable object is not clear; the treatment of the accountability can be hardly carried out, and the system and social effect are directly influenced.In order to solve the above-mentioned problems, the related law and regulation are used to find out the path to solve those problem existed in the administrative accountability of safety work. Firstly, the concept of administrative accountability is further valued on the base of research from some scholars. Then the question why strict administrative accountability in safety work should be carried out is presented and analyzed. The existed problems in carrying out administrative accountability are explored. Finally, five countermeasures are proposed, including unification of legislation of administrative accountability and standardization of behavior of administrative accountability in safety work; establishment of performance-oriented merit system of safety work in local government; consummation of matching systems such as the system of affixing the responsibility for an accident and the system of supervision of public opinion; prominence of status and function of supervision department for smoothly carrying out administrative accountability in safety work; strengthening propagation and education to form favorable environment to push out administrative accountability in safety work...
