Research On Administrative Legislation Power Of Cities With Districts

With the amendment of China's legislative law in March 15 2015,cities with districts have gained legislative power in urban and rural construction and management,environmental protection,historical and cultural protection,etc.,and have become the most extensive subject of legislative authority and power in China.Urban legislation has ushered in a new opportunity for booming development.The city with districts in China is the key point in the strategy of urban agglomeration.The administrative legislation of the city with districts is an important part of the national legislative system.The role and influence of urban legislation will continue to expand.It is an inevitable requirement to promote the development of the rule of law in China to give full play to the role of urban legislation.In addition,the 19 th CPC National Congress put forward "legislation according to law" as a new development direction for the regulation of administrative legislation.The transformation of China's economy requires a healthy and perfect legal environment.Therefore,it is of great practical significance to systematically sort out the administrative legislative power of cities with districts from the logical origin of the administrative legislative power of cities with districts,and to study the concepts,powers,procedures and evaluation of the rule of law of the administrative legislative power of cities with districts.This article uses the normative law research method,the positive analysis method,the qualitative analysis and the comparative analysis,explores the occurrence logic of the city legislation,and traces the origin from the origin of the medieval city legislation and the evolution of the modern city legislation.Combined with the comparative analysis of the development of urban legislation between China and foreign countries,it shows that the origin of urban legislative power has a long history.First of all,starting from the concept of the municipal administrative legislative power of the district,the concept of the power of the municipal government to formulate regulations is clarified,and the basic principles of its legislation are further elaborated.Secondly,from the perspective of the municipal administrative legislative power of the district,analyze the issue of administrative legislative power,the status quo of the use of regulations in practice,and the use of sample survey methods for different cities after the municipal government of the district obtains the power to formulate government regulations.The current status of government regulations is counted and the problem is further described and analyzed.Thirdly,the administrative legislation activities are standardized and designed from the procedural aspect.Learn from the provisions of the legislative law on the law-making procedures,make a detailed analysis of the design and implementation of the municipal administrative legislative procedures in the district,and emphasize the role of public participation in the administrative legislative process.Finally,the design of the rule of law in administrative legislation is used as a realistic response to evaluate the activities of administrative legislation.Starting from the value of administrative legislation in the district,the objectives of urban administrative legislation are embodied and concretely implemented through the indicator system.The concept definition and procedure design of the municipal administrative legislative power in the district is a new problem in the development of urban law.Establishing the rule of law evaluation system is a concrete implementation and realistic response to the national legislative spirit.This is a healthy development of China's urban legislation and “ruling the country according to law”.Construction has a positive meaning.
