The legislation of civil civilized behavior is a local legislative topic which attracts much attention in recent years.People's yearning for a better life has developed from the material field to the equal attention of the material and spiritual fields.However,in real life,the enrichment of material civilization has not led to the simultaneous improvement of spiritual civilization,and some uncivilized behaviors that seriously affect public life and public order have seriously delayed the progress of the overall civilization of the society.It has become a social demand to regulate uncivilized behavior by local legislation and to promote the widespread dissemination of civilized ideas and behaviors,which has also become a reality in Shenzhen,Xiamen,Ningbo and other cities.However,what kind of behavior is uncivilized behavior and what kind of behavior should be included in the local laws and regulations is a problem that the legal community has not yet given a unified answer.That is to say,the current understanding of the standard of civil civilized behavior legislation is not clear,and insufficient theoretical preparation will lead to practical conflict.The purpose of this paper is to discuss the above questions and give a tentative answer combined with practice.This article is divided into five parts,the introduction discusses the citizen civilized behavior research background,research situation at home and abroad and domestic legislation present situation,at present,the domestic and foreign relevant theories generally more attention to moral legislation,and citizen civilized behavior legislation should belongs to the category of moral legislation,therefore,the department is divided into citizen civilized behavior legislation provides a theoretical support.The first chapter summarizes the definition of civil civilized behavior and civil uncivilized behavior as well as its basic performance.At the same time,it conducts an empirical investigation on the status quo of civil behavior in district J,Fuzhou.Based on the investigation results,it fully discusses the legal basis and necessity of local legislation on civil civilized behavior.The second chapter summarizes the current situation of local legislation on civil civilized behavior in China,and takes the typical case of civil behavior legislation in Xiamen city as an example to discuss the main problems,such as the non-unity of legislative standards on civil civilized behavior,the lack of local features in legislative standards,and the over-generalization of legislative standards.The third chapter is mainly about the theoretical analysis of the legislative standard of civil civilized behavior,and elaborates respectively from the local characteristic standard,non-conflict standard,operational standard,ethical legislation standard,and special standard of promoting legislation.The fourth chapter analyzes the legislative basis,types and standards of civil uncivilized behavior into law,and puts forward the standard construction of civil civilized behavior legislation,and takes the specific standard construction of civil civilized behavior legislation in Xiamen as an example,so as to have reference significance to other regions.
