Local Pre-legislative Assessment

2015 "Legislation Law" to make changes,extend legislative power to all city divided into districts,make the local legislative body further expand,at the same time,with the construction of socialist rule of law,our legal system has been completed,every aspect there are laws to follow,making local legislation into the era of "fine decoration",scientific legislation and democratic legislation have become the mainstream of the times.How to improve the quality of local legislation has become a hot topic,and legislative evaluation has become a better way.However,for a long time,Chinese scholars and local legislative practice have mainly focused on the evaluation after local legislation,and there are few studies before local legislation.At present,there are different views on the stage of local pre-legislative evaluation,the main content of evaluation,and the setting of evaluation indicators,and the image of each word is formed.This study analyzes the different views of the pre-existing evaluation in the theoretical circle,the legislative provisions in practice and the prelegislative evaluation system in the United States,finds out the advantages and disadvantages,and proposes a pre-legislative assessment that meets the local characteristics of China.“General” indicators and “segmental” indicators.The “general” evaluation index is a legislative evaluation indicator applicable to all types of local legislation,and the “pre-legislative” local pre-legislative evaluation indicators are some of the indicators that need to be evaluated in addition to the relevant indicators of the “General Provisions”.index.Among the "sub-rules" indicators of the evaluation,the classification of representative local legislation is mainly selected,and the evaluation indicators of economic management,the evaluation indicators of environmental categories,and the evaluation indicators of prohibited categories are analyzed.In the end,the quantitative analysis of the indicators for evaluation is discussed.The quantitative analysis of the indicators and the determination of the weights of the indicators are analyzed.The indicators are also divided into the assessment of subjective indicators and the evaluation of objective indicators,with an emphasis on the assessment of costs and benefits.In the end,the indicators for pre-legislative assessment are more feasible and operational,and the quality of local legislation has been improved from the “source”.
