After President Xi Jinping put forward the "One Belt And One Road" initiative in 2013,the process of investment and trade development cooperation between China and countries along the "One Belt And One Road" has been continuously promoted.As China's second largest neighbor,Kazakhstan is not only the first stop for the Silk Road economic belt to the west,but also the most representative investment destination for Chinese enterprises in Central Asia.The economic exchanges between the two countries are increasingly frequent.Economic and trade cooperation has flourished.Years of trade cooperation have made China the second largest trading partner of Kazakhstan except Russia.In recent years,the economic and trade relations between China and Kazakhstan have continued to develop steadily.Many Chinese companies have seized the opportunity to choose to go to Kazakhstan for investment and trade production activities.At present,more than 3,000 Chinese companies have settled in Kazakhstan.However,due to some differences in the business environment between the two countries,various problems encountered by Chinese companies in investing in Kazakhstan are quickly exposed,especially enterprises.When carrying out production and management activities,the labor law risks faced by them are the most frequent and direct.The reality and necessity of studying Kazakhstan's labor legal system and formulating countermeasures are increasingly prominent.When the relevant laws of the destination country of investment comes to update iterations,it is particularly important to know the latest legal contents and take active measures to avoid the legal risks brought by the changes in the old and new labor laws.Therefore,studying the new "Labor Law of the Republic of Kazakhstan" has practical significance for Chinese enterprises to better invest and carry out business activities in the local area.Through the analysis and comparison of the new and old labor laws of Kazakhstan,this article concludes the modification and supplement of the new labor laws,and summarized the characteristics of the new labor law relative to the old labor law.Then according to the changes in the new labor law content,it stated the impactof the implementation of the new labor law on Chinese enterprises investing and operating in Kazakhstan: Although the implementation of the new labor law has caused a negative impact on the increase of wage costs,it has also helped Chinese enterprises expand the right to hire and select workers in the local labor market and provided legal basis for them to optimize the allocation of resources.The introduction of the new labor law has brought more benefits than disadvantages to Chinese enterprises.Under the regulation of the new labor law,Chinese enterprises should improve their internal management rules and regulations as much as possible on the basis of fully understanding and fully complying with the new labor law,promote flexible employment and reduce wage expenditure as much as possible,and actively seek ways to circumvent labor legal risks,to lay the solid foundation for Chinese enterprise to achieve long-term sustainable development in Kazakhstan's future economy market.This article focuses on the new Labour Law of the Republic of Kazakhstan,which came into effect on January 1,2016,and is divided into three parts.The first part introduces the reason why the author chooses to take Kazakhstan's new labor law as the research object and the significance of the research.The second part,on the one hand,it sorts out the historical changes of Kazakhstan's labor law,analyzes the motivation of Kazakhstan's revision of the new labor law,and on the other hand,starting from the comparison between the old and new labor laws,this paper introduces and analyzes the modification and supplement of the new labor law in Kazakhstan compared with the old one,and summarizes the characteristics of the new labor law in Kazakhstan.Thus providing a way for the Chinese government and enterprises to understand the new labor law of Kazakhstan in the process of investing in Kazakhstan,and try to avoid the labor problems or negative comments caused by Chinese enterprises' ignorance of this law.In the third part,under the background of a large number of Chinese enterprises going to Kazakhstan to carry out business activities,the author will analyze the impact of the new labor law on the Chinese enterprises in Kazakhstan according to the contents of the new labor law supplement and revision,and provide some advice for Chinese enterprises business development.
