As an important part of ancient Chinese legal culture,traditional family culture played an important role in society.The Qing Dynasty was a period of perfection of traditional family culture in China.It played an important role in the governance of rural areas in the Qing Dynasty.The rulers also recognized the family system through legislation.Starting from the family system of the Qing Dynasty,this paper analyses the role of the family system of the Qing Dynasty in the rural society,and illustrates the important role of the family in local governance by combining the lack of state power in the rural society during the Qing Dynasty,the law of Bao Jia is in vain and the special status of the squires in the Qing Dynasty.Local autonomy in the sense of modern constitutionalism originated from the autonomy of towns and townships under the preparatory constitution in the late Qing Dynasty.Against the background of internal and external troubles and the background of legal changes,the Qing government promulgated the Constitution of Local Autonomy of Towns and townships,which changed the local governance form since then,but it still retained the shadow of traditional family governance.At present,rural autonomy is an important part of our constitution.How to overcome various difficulties,traditional family governance is an indispensable reference.The article has five parts in total,The first chapter introduces the background and purpose of writing this article,the current research situation of domestic and foreign scholars;some writing paths and techniques,novel points and defects in this paper.In the second part,the constitution of Qing Government's power,explain the vacancy of Qing regime in rural areas,then the Qing Dynasty's Baojia system,was basically a dead letter in the grass-roots society,the squires in the rural society of the Qing Dynasty had special legal status,on the one hand,intersected with the local intellectuals and the government,on the other hand,was subject to the family as a member of the family.The third part starting from the inherent characteristics of traditional rural society,needs the help of the family,the family system played an obvious role in the rural society of the Qing Dynasty.The fourth part,the autonomy of Towns and country under the Preparatory Constitution in the late Qing Dynasty,the grass-roots political power structure was forced to change,butthere is still a shadow of the family system.It has made a significant exploration of the future rural construction.In the fifth part,rural autonomy in contemporary China,after the founding of the People's Republic of China,the governance model of village governance has been formed in the process of exploration,a series of rules and regulations have been promulgated.However,there are still various contradictions.Family system which has lasted for thousands of years in traditional China can be used for reference.
