A Study On The European Legal System Of Refugee Protection

The United Nations High Commissioner for Refugees(UNHCR)of the UN Refugee Agency produced and printed Global Trends Forced Displacement in 2017 on 25 JUNE 2018.As the end of 2017,there were around 6.3 million Syrians refugees,in the meanwhile,Turkey continued to be the country hosting the world's largest number of refugees from 2.9 million at the beginning of the year to 3.5 million at the end.The Statistical Office of the European Union publicize that around 730,000 refugees apply for asylum.The particular feature of the European refugee crisis lies in the complexity of the issue itself.To be specific,the issue involves the whole economic,political and cultural behalf of European countries and they are unable to stand as one.Therefore,the European community treats the refugees in different legal systems.At the same time,the crisis unveiled the deficiency of the International refugee protection law which still centers on the 1951 Convention relating to the Status of Refugees and the 1967 Refugees Protocol.The definition of refugee in the two documents is behind the times.With the improvement of the European legislation and the publishment of new policy,the impact on China's overseas interest and foreign policy should not be overlooked.On the one hand,the essay presents the content of the European legal system of refugee protection.On the other hand,it compares and analyzes the legal system of a few main European countries.In general,the essay is for the sake of the legislation of our country.Beside the introduction and the epilogue,the whole essay is divided into four chapters.The first chapter is a summary of the European refugee issues.It introduces the concept of refugee which is definited by the international treaty and the legal rights of refugee.The refugees are divided to four categories by the reason of politics,economics,environment and war.Meanwhile,it presents the cause of the European refugee crisis contains the International political,religious and special geopolitical factors.The refugee crisis has an severe effect on European countries in the respect of economics,society,cultured politics.This chapter also listed the legal basis such as the basic documents of International refugee law,European regional convention and national legislation.The second chapter analyzed the European legal system of refugee from identification and resettlement.The identification part introduces the Dublin Regulation and Asylum Procedure Directive and proposed improvement suggestion for the deficiency of the identification procedure.The resettlement part lists the Maastricht Treaty and the European Asylum System.It also indicates the lack of resettlement standard and the views to modify.The main content of the third chapter is about the refugee legal system in European countries.Comparing Germany with Britain,the two legal systems are quite different in the way of the identification of the qualification and the development and comparison of their laws and policies.Furthermore,this content makes a discussion on the law and policy of Turkey,Greece and Sweden.Chapter four draws a conclusion on China's refugee protection legislation.Currently,our country has a few issues in the respect of unspecified affirmation standard,unincorporated identification procedure and undefined treatment standard.Therefore,learning the continuously improving European refugee legal system is conductive to the development of our country's legislation.
