A Study On Rule Of Law In The Governance Of School Bullying

In recent years,school bullying incidents occur frequently,the seriousness and concealment of the incidents are gradually rising,and those bullies are becoming younger and younger.School bullying not only severely endangers the physical and mental health of juveniles,but also ruin the the order of the school daily management.Especially for those bullies,if we ignore interfering with those bullying behavior,those bullies is likely to embark on a path of delinquency where from the learning of infamy.For those victims who suffer from bullying,when they can not find a way to get rid of being bullied,under this situation,it will lead more violence and even school bloodshed.In view of this harmful social problem,in most cases,we still use moral means to deal with it such as criticizing and educating,which is useless.This is far from making effectively control of campus bullying.Rule of law is the most effective way to realize social governance.Every student's campus life is a rehearsal for entering society in the future,their behaviors will affect social public order,Only by realizing the rule of law of campus bullying can we really solve this worldwide problem.Base on this purpose,this dissertation aims to discuss how to realize the legalization of the governance of campus bullying.The whole paper is divided into four parts.The first part introduces the related content of governance of the campus bullying,including the definition,types and causes of campus bullying,analyzing those concepts of the legalization of campus bullying governance,the necessity of the legalization of campus bullying governance and some legal relationships involved in the governance of campus bullying.The second part summarizes the difficulties faced by the legalization of campus bullying governance which from the perspectives of legislation,law enforcement and justice.The third part introducing and evaluating the rule of law experiences in the management of campus bullying in foreign countries and regions.From the perspective of public law,the last part providing a beneficial references for how to realize the legalization of campus bullying governance in our country on the basis of combining the conditions of our country and learning outside experiences of school bullying governance.The rule of law in the governance of school bullying governance is far more than simply dealing with the civil compensation between the bullies and the victims.Governance is a diversified mode of dispute settlement.Only by clarifying the rights and obligations of students,parents,schools,state organs and social organizations in the governance of campus bullying,can this social problem be effectively solved and obtain lasting social benefits.
