Research On The Legislation Of Urban Residents' Minimum Living Security Administrative Assistance

Since Shanghai city residents' minimum living security line was put forward in 1993,the administrative assistance of the urban residents' minimum living security system with the administrative organ as the main body has come into being.Up to now,all parts of the country have formed a full coverage of the urban residents' minimum living security administrative assistance system,the relief effect is beginning to achieve results,but also for the object of humanitarian care.However,due to the social development and the construction of the system,there are some problems in the operation of the administrative aid for the minimum living security of the urban residents.In the legislation,the scope of aid is not specific,the standard of rescue is low,the way of aid is single,and the connection between various kinds of aid is insufficient.The supervision mechanism is not perfect.In practice,the scope of assistance is small,the standard of assistance is low,and there are some differences between urban and rural areas.Therefore,it is necessary to perfect the legislation of our country,to refine the scope of aid,to improve the standard of aid,to construct the multi-way of aid,to perfect the supervision mechanism,and so on.First of all,this paper analyzes the concept and related concepts of administrative assistance for the minimum living security of urban residents,and clarifies its theoretical basis from the two aspects of basic human rights and administrative payment.Secondly,on the basis of combing the current legislative situation of administrative assistance for the minimum living security of urban residents,the scope of assistance in legislation and practice is not specific,and the standard of assistance is poor.Different,the rescue mode is relatively single,and there is no effective link-up with other aid,and the lack of effective supervision of the rescue and other issues are discussed.Finally,based on the investigation of the United States,Britain,Japan and other countries,we can refine the scope of aid in our country,balance the standard of aid,develop the multi-way of aid,and strengthen the connection between various kinds of administrative aid.The exit mechanism of the rescue and the perfection of the supervision mechanism put forward perfect suggestions.
