The Research On The Construction Of Culture Of The Rule Of Law Against The Background Of Comprehensively Implementing Rule Of Law

The culture of the rule of law,as the combination of the realization degree of both legal system and the spirit of rule of law in our country and the degree of legal belief in our society,plays a fundamental role in the strategies of comprehensively implementing the rule of law.The cultivation and construction of culture of the rule of law,thus building a favorable atmosphere of rule of law culture,is an inherent part and an important engine of the comprehensive implementation of rule of law as well as the construction of a country under the rule of law.Under the great background of comprehensively implementing rule of law,this thesis systematically studies the core,essence and functions of the culture of rule of law as well as the dialectical relationship between the culture of rule of law and comprehensively implementing rule of law;also it deeply explores the practical strategies in the construction of the culture of rule of law under the background of governing a country according to law.This thesis consists of four parts.The first part is introduction,which puts forward the reasons on studying the construction of the culture of rule of law under the background of ruling the country by law.It expounds the theoretical significance and practical significance of the study on the construction of the culture of rule of law,and on the basis of those researches it further clarifies the relative conceptions about culture of the rule of law,summarizes the relative research status about the domestic and overseas culture of rule of law and explains the characteristics and innovation of the perspective of this thesis.The second part is about the culture of rule of law and its functions.In this part,the author elucidates the basic connotations of the culture of rule of law and investigates the rise of the culture of rule of law and its historical background.This part expounds the core of the culture of rule of law----that is the spirit of rule of law;the essence---the identification,advocation,abidance and compliance of the culture of rule of law from the prospective of Marxist Epistemology.Furthermore,this part also thoroughly discusses the functions as value guidance,cultivation and regulation,norm of behaviors that the culture of rule of law possesses and analyses the fundamental role those functions play in the strategy of comprehensively implementing the rule of law.The third part illustrates the view that strengthening the construction of rule of law is the strong urge for comprehensively implementing the rule of law.This part explicitly proposing and deeply stating that rule of law is the basic mode of governance of modern countries;that the culture of rule of law is the historical precipitation in the internalization of rule of law;that the comprehensively implementing rule of law extensively promotes the culture of rule of law;and that the construction of culture of rule of law is the fundamental project in comprehensively governing the country according to law.The fourth part is about the problems existing in the construction of the culture of rule of law and countermeasures of those problems under the background of comprehensively implementing the rule of law.This part analyses the problems existing in the construction of the culture of rule of law in our country,including that the system and mechanism of the construction of the culture of rule of law need to be perfected;the communication system of the culture of rule of law is not well established;the citizens' weak consciousness of culture of rule of law and the favorable atmosphere of the construction on culture of rule of law is not created.For these problems the author proposes that we must focus on the construction of the culture of rule of law under the background of comprehensively implementing rule of law,further improve the system and mechanism of the construction of the culture of rule of law to establish a sound,scientific and effective dissemination system of the culture of rule of law,positively cultivate the entire citizens' cultural consciousness of rule of law and strive to create a favorable atmosphere of the construction of the culture of rule of law that the whole society commonly concerns.
