Since the implementation of community corrections in China in 2003,it has aroused the attention and research of all walks of life.Corrective work has also been recognized by the masses as a whole in China,and the effect is quite good,but for this effect,no matter from social effects,In terms of policy effects or legal effects,the components of the effects seem to be mostly occupied by urban communities.The contribution of rural communities to this effect seems to be minimal,and it is particularly tacit that legislators,implementers,and scholars seem to ignore them.at this point.The number of specialized special studies on rural community correction systems and correction of current conditions is limited,and even if it is,it only involves some basic concepts.Since 2009,China has carried out rural community corrections,but theoretical research and empirical research are far from being comparable to urban community corrections.Especially in rural areas in underdeveloped areas of western China,community corrections have not been implemented in depth.Unlike other countries,China is a country with a large proportion of agricultural population,and rural areas play an important role in China’s development.Constrained by the reality of urban-rural dual structure,compared with urban communities,most rural communities are relatively weak in resource integration and public resource allocation,which has become the limiting factor for the differential development of urban and rural community correction work in current correction work.In addition,the relevant legislation is insufficient,the system is incomplete,the professional level of the basic judicial staff is not high,the professional equipment and professional mechanisms are insuff-iciently equipped,the funds are insufficient,the people’s concept and legal system are weak,and the overall rule of law environment is poor.These problems all restrict the development of this system.However,this does not mean that it is unrealistic to implement community corrections in rural areas.On the contrary,this will be an opportunity to change the differential development of urban and rural areas.Therefore,studying the rural community correction system provides a meager strength for building a rule of law rural area,raising the level of the rule of law,and building a harmonious and civilized modern village.The article mainly studies from the following points:The first chapter generally grasps the basic concepts of rural community correction.Before making a deep understanding of the rural community correction system,we must carry out the necessary research on the literal interpretation,and then start from the current definition of rural community correction,carry out in-depth mastery,study its essence,and lay the foundation for the next writing.Through grasping the theoretical basis,this paper has a clearer understanding of the theoretical value and practical significance of the rural community correction system itself.Finally,explore the necessity and feasibility of the existence of the system from different angles.The second chapter is the status quo of legal regulation of rural community correction.This paper studies the current situation of rural community correction system legislation,the development of rural community correction system and the dilemma of implementation,and discusses the necessity and value of its existence.The third chapter finds out the shortcomings of the current situation of corrective work.Firstly,an example is given to analyze the current situation of community correction work in Fengqiao Town,Zhejiang Province,and to explore the current status of implementation of rural community correction system in China.Thus,problems existed in the status quo.The fourth chapter puts forward some views and expectations on how to improve the rural community correction work in China.Starting from the perspectives of legislation,law enforcement,judicature,and law-abiding,I put forward some feasible suggestions for myself,hoping to contribute to the building of a new socialist legal system. |
