The Practical Problems And Solution Of Community Correction Of Juvenile Offenders

Community correction is a form of protection for juvenile offenders.Judging from the current research situation,scholars have already realized the value of community corrections in the execution of penalties for juvenile offenders,and from the practical aspect,there has also carried out a lot of operational design.However,compared with the foreign minors community correction system,there is still a big gap in China,which shows that there is still insufficient attention to the subjects of juvenile correction,and There are still many shortcomings in practice.In the process of minor community correction practice,how to grasp the rationality of implementation measures,how to carry out specific projects,and whether they can be implemented still requires our attention.The article explores the dilemmas encountered in the practice of community correction in China's minors,analyzes the causes of practical problems,and then proposes solutions to problems so that the positive effects of community corrections on minors can be better played,at the same time,the practice promotes the development of the theory of minor community correction.This article consists of five parts.The first part is the introduction,expounding the research background and significance of the community correction practice of minors in China.Combined with relevant domestic legislation and judicial practice activities,it summarizes the research status and achievements of community correction research for minors at home and abroad,which leads to the analysis and thinking of problems in the community corrective practice of minors in China.The second part,which is the first chapter,is the practice status and existing problems of the community correction of minors.The first chapter is divided into two sections,the first section outlines the concept and development of minors' community corrections,The second section illustrates the dilemma in the practice of community correction in minors,which are elaborated in three stages of the work of minor correction.The first is the problem of system construction before the minors correction,followed by the loopholes in the implementation of minor community corrections,and the final is the problem of the aftermath.The third part analyzes the causes of the practice of community correction of minors from two aspects.First,the common reasons for the practice of community corrections,including the poor development of community mechanisms and the weakfoundation of social identity,and the fact that the connection mechanism is not linked.Second,the special reasons for the practice of community correction in minors,including the fact that the degree of socialization of minors is not high and the concept of underage individualized correction is not formed.The fourth part is the focus of this paper.From three aspects,it puts forward suggestions for improving the community correction of minors.First of all,lay the institutional basis for the correction of minors' community corrections,mainly to promote community correction legislation,and establish a special chapter for minors in the Community Correction Law,and improve the rate of application of community corrections for minors.Secondly,improve the operation management of minors' community corrections,including the following five measures,strengthen the construction of minors' community correction professionalization team,formulate corrective plans that meet the characteristics of minors,and set up community correction projects that are different from adults.Improve the assessment system for minors and promote the sharing of information among minors and joint enforcement by various departments.Finally,to promote the settlement of minors community corrections,the main measures are to change the attitudes of the people and schools,and improve the protection of minors' rights and interests.The fifth part is the conclusion,which emphasizes the importance of community correction to minors.It summarizes the solution to the problem of community correction practice in minors,and puts forward the possible shortcomings of the article.
