The Practical Difficulties And Legislative Perfection Of Juvenile Community Correction In China

Since the middle of last century,countries with advanced legal systems have gradually attached importance to the sociality of correction in the process of crime correction,and community correction has become one of the main ways of juvenile crime correction.After more than half a century of practice,it has been proved that the socialization of juvenile community correction is more conducive to the return of juvenile delinquency to society.China's community correction started in 2003,from the pilot to now,community correction in the prevention of juvenile delinquency has made a series of achievements.However,compared with countries with developed legal systems,China's community correction started late and the legislation is rough,and there are still many things to be improved.Our country there is no special community correction law,the existing legislation and no special provision for minors,lead to juvenile community correction appeared in the process of implementing the correct project pertinence is not strong,the correct way to formalize and rectification personnel structure of the single,juvenile community correction did not achieve the desired effect.A perfect juvenile community correction enforcement measures,not only need to community correction workers detailed risk analysis of minors crime,crime psychology,and combining the minors' physical and mental characteristics,targeted corrective plan and case and correcting methods,and shall track evaluation corrective effect,promote the juvenile offenders know wrong,sets up the correct recognition of society and their own,thereby reducing the occurrence of recidivism.Based on the above reasons,this paper uses empirical research,comparative analysis,literature analysis and other methods to carry out in-depth research on the practical dilemma and legislative improvement of juvenile community correction in China.This paper on the basic theory of community correction of juvenile problems to study,reviews the juvenile community correction in the process of the establishment and development of our country,to clarify the value of community correction and juvenile particularity,on the basis of the survey analysis,juvenile community correction in our country to the plight of the comb,analyses the reasons of the existence of these problems.By investigating the foreign community correction of juvenile,juvenile community correction on legislation of other countries for reference of successful experience,according to the situation in our country,this article from the system of the legislation improvement of community correction of minors,setting up community correction discussed with minors,specific implementation main body,puts forward the concrete suggestion to execute a program.
