The right to education is one of the most basic rights entrusted to all citizens by the Constitution.Children with disabilities are special vulnerable groups in society.As members of citizens,they are also protected by the Constitution.Special education is an important part of the national education system and an important manifestation of social equity.In the course of the construction of the rule of law in our country,laws and regulations specializing in the protection of disabled children’s equal right to education have gradually formed a systematic legal protection system from construction to development,which all depend on the construction of the legal system and the continuous improvement of the legal system construction in our country.But at the same time,we can also see that the education of disabled children has always been a short board in our country’s various education.In real life,the realization of the equal right to education of disabled children in China is not optimistic.Compared with normal children,disabled children’s education faces many problems and difficulties,such as low enrollment rate and high dropout rate.Reviewing the laws and regulations promulgated in China on the protection of disabled children’s right to education,the contents are only stipulated in principle and form,and the provisions of the laws and regulations are also included.The lack of in-depth discussion of specific safeguard rules and detailed responsibility attribution for the protection of disabled children’s right to education reflects that China’s existing legal system for the equal protection of disabled children’s right to education is relatively weak.Therefore,it is necessary to improve the construction of relevant legal system and standardize it from the legal level to ensure that the equal right to education of disabled children can be truly realized.
