Research On The Legal Regulation Of Government Purchase Of Public Services

In the late 1990 s,the Chinese government's purchase of public services began to rise.It is an important way for the government to carry out public services through market competition mechanism,and it is also a new type of administrative method to adapt to the transformation of government functions and realize the "service-oriented" government functions.Although the government's purchase of public services started late,it has developed at a faster rate and has spread to many fields.At the same time of its rapid development,many problems have emerged,such as the lack of systematic legal norms and lack of supervision.The government's purchase of social public services is a transformation of its own functions,and it is also the need to adapt to the needs of the growing public social services.In the era of the rule of law,the government's purchase of social public services will inevitably require legal regulation.This article is divided into five chapters:Chapter 1,"Introduction",expounds the background,research purpose and significance of the topic,and introduces the research history and development status of the subject and the main content of the thesis.Chapter 2,“Overview of the Government's Legal Regulations for the Purchase of Public Services”,this section first explains the concept of public services,introduces the concept and method of government procurement of public services,explores the legal relationship between government purchases of public services,and analyzes the theoretical basis for government procurement of public services.Including regulation incentive theory,legal interaction theory,government failure theory and social standard theory,then expounding the basic principles of government procurement of public services,and finally propose government through three aspects: government transformation to improve efficiency,legal supervision and management,and fair implementation.The need to purchase legal regulations for public services.Chapter 3,“Investigation and Enlightenment of Foreign Governments Purchasing Public Service Legal Regulations”,this section introduces the US,UK and Japanese government's purchase of public service legal regulations,and from the following aspects: perfect government procurement regulations system,sound purchase management Ways and procedures,special government purchasing agencies and teams,effective government procurement supervision,and a more complete government procurement information system provide lessons for the Chinese government to purchase public services.Chapter 4,“There are problems in the legal regulation of the purchase of public services by the Chinese government”,this section separately from the government to buy public services,the legal norms are not perfect,the government purchases public services is not clear,the government purchases public services is not standardized,and the government purchases public services information.The incomplete disclosure and government procurement of public service supervision and management are not in place to discuss the problems of the government's purchase of public services.Chapter 5,“Improving the Government's Countermeasures for Purchasing Public Service Legal Regulations”,this section addresses the problems of the government's purchase of public services,proposes to improve the government's purchase of public service laws and regulations,scientifically define the scope of government procurement of public services,and regulate the government's purchase of public services.The purchase process,the improvement of the government's purchase of public service information disclosure system,the improvement of the government's purchase of public service supervision and management system and the improvement of the government's purchase of object supervision mechanisms,in order to achieve the government's legalization of the purchase of public services.
