The Study Of The Judicial Cooperative Strike Mechanism Of Cross-border Fraud In Taiwan

It's a war without smoke that combating cross-border telecommunications fraud.Recently,Taiwan fraudsters brazenly commit crimes against mainland citizens,causing heavy losses to the people's property in the mainland.So,the ministry of public security has paid great attention to the investigation of cross-border telecommunications fraud committed by Taiwan nationals.In consideration of the fact that cross-border telecommunications fraud could not be combatted once,and considering my work practice,this article mainly discusses the cooperative strike mechanism of cross-border fraud in Taiwan from the following aspects.There are 3 parts,the main contents are:The first part is the overview of cross-border telecommunications fraud crime in Taiwan.Firstly,the definition of the concept of Taiwan nationality cross-border telecommunications fraud.Secondly,elaborating the aspects of crime means,crime locations,the number of cases such as the emergence and development of cross-border telecommunications fraud from the beginning of the late twentieth Century.Finally,summarizing features of Taiwan nationality cross-border telecommunications fraud from cross-border crime,crime of widespread,criminal means like professional etc.The second part is about the dilemma of cross-border fraud committed by Taiwan nationals.Combined with the complicated and changeable relations between the two sides of the Taiwan Straits after the ruling of the DPP,the current difficulties faced by the two sides in the fight against cross-border telecommunications fraud are analyzed.First,the lack of effective judicial assistance on both sides of the Straits.Second,China's foreign extradition provisions is imperfect.China has established judicial assistance and extradition treaties with63 countries in the world,but there are some countries without diplomatic relations with China do not admit a China principle,so China extradition fraud suspects from Taiwan encounters some difficulties.Third,it is limited by time,space,manpower and material resources,which leads to the arrest of the leader of the crime and the difficulty of dealing with the crime.Fourth,it is difficult to reach agreement between the Taiwan authorities and the political parties.Fifth,fraud crime penalty in Taiwan is too low,many criminals view Taiwanas their crime sheltered bays,and most of the released prisoners will recommit.The crime of fraud becomes more and more.The third part is the construction of Taiwan nationality cross-border telecommunications fraud mechanism.From the development of friendly cooperation in the fight against the protection of cross-strait economy,safeguard the common interests of both sides and good social order,put forward to build cross-border telecommunications fraud cooperation mechanisms to combat countermeasures.First,strengthen cross-strait police cooperation,establish and improve the rapid reaction of the judicial assistance system.Secondly,actively establish crime the information exchange channel,as the depth of the investigation,in order to provide clear direction and goals.Thirdly,carry out the investigation of evidence,according to the international convention or the two sides signed a mutual aid agreement of judicial investigation,improve the normalization of information exchange,case,criminal suspects arrested work.At the same time,improvement of recovering illicit money and disposition,improve the efficiency of the work.Finally,to strengthen the supervision to improve the efficiency and anti fraud center as a platform,combined operations,to prevent telecommunications fraud,Yan Crack down on Telecom fraud suspects.
