For a long time in our country,real estate were separately registered and managed by housing management.Land and other immovable property were separately registered and managed by different other departments.This situation resulted in the disunity of the registration scope,unclear ownership relations,and complicated registration procedures.This has seriously affected the security of real estate transactions and the registration costs of the right holders.In 2007,the National People's Congress formulated the Property Law.And in 2014,the State Council issued the "Provisional regulations on Registration of Real Estate".In 2016,the Ministry of Land and Resources formulated the "Rules for the Implementation of the Interim Regulations on Registration of Real Estate" which optimizes and integrates the original decentralized registration agencies,registers,registration bases and information platforms.Then the Ministry of Land and Resources establishes a unified registration department.It opens a new chapter in the unified registration of real estate,which provides an effective guarantee for simplifying the registration procedure of real estate,clarifying the ownership of real estate and ensuring the transaction security of real estate market.Taking N city as an example,this paper illustrates that although the unified registration system of real estate has been fully developed in N city,the following problems have arisen in the process of implementation: the organization construction of registration system is insufficient,the data integration is difficult,legal system of this system is not perfect,the information platform construction is slow and so on.This paper analyzes the unified real estate registration system in N city which is put into effect for more than two years,studies the problems found in the practice of the system,and puts forward corresponding countermeasures and suggestions.All the measures are helpful to improve the unified registration system of real estate in N city.This article mainly from the following six aspects to elaborate.The first chapter is the introduction,focusing on the research background and significance of this paper,and related research reviews,the main content of this paper and the main research methods are described.In the second chapter,the relevant theories of unified registration of immovable property are expounded,and the legal basis of unified registration of immovable property is discussed systematically on the meaning of real estate and registration of immovable property.At the same time,the core contents of the unified registration system are explained accordingly.The third chapter studies the problems existing in the implementation of the unified registration system of real estate in N city.The fourth chapter analyzes the causes of the problems in the implementation of the unified registration system of real estate in N city.The fifth chapter studies the experience that can be used for reference in the unified registration system of foreign real estate.It mainly includes contract registration,right registration and Torrance registration.The sixth chapter puts forward the countermeasures and suggestions to optimize the implementation path of N city real estate unified registration system.The last part is the conclusion of this paper,including the summary of the full text and the prospect of the future development of the unified real estate registration system.
