The Role-playing And Dilemma Of Judicial Social Workers In Family Trial

Since 2016,China has carried out pilot work on the reform of family trial,and courts around the country have started to explore practice.In response to the Supreme People's Court's policy advocacy for social forces to participate in the reform of family trial,social work has participated in it actively,actively carried out beneficial exploration in family investigation and social care.The corresponding work norms and models have been initially explored for judicial work added flexibility and passed the humanistic care from the judiciary and society to the public.Based on the related practice of social work participating in the family trial service project,this research adopts the perspective of structural functionalism and social role theory,takes the judicial social workers as the research object,by interviewing with court staff,clients,professional supervision and judicial social workers,using the completed practical cases as support to analyze and discuss the role-playing process of judicial social workers in family trials.This study found that judicial social workers mainly serve as family investigators and social care workers in family trial services.In the process of serving as a family investigator,judicial social workers mainly play the role of data collectors and listeners;in the process of serving as social care workers,they mainly act as supervisors,communication coordinators,supporters,service providers and so on.At present,the judicial social workers involved in the family trial process do not have a clear legal status,and the clients generally lack understanding of social work or judicial social workers.And the role expectations of courts,institutions,clients and judicial social workers themselves are not coordinated,All of these may lead to the role dilemma of judicial social workers in the process of service,which not only affects the smooth development of service,but also has a negative impact on their own emotions and psychology.In order to solve the role dilemma,we can seek solutions from four aspects:laws and regulations,profession,institution and judicial social workers themselves.As the relevant practice and research is still in the initial stage,there is less mature experience for reference,this paper on the role of judicial social workers can provide a reference for the development of similar services and related research.With the continuous development of practice and research,the operation mode of social work participating in family trial service will be more and more standardized,and will play a more powerful role.
