| Education is the cornerstone of national rejuvenation and social progress,and the right to receive education is a basic right granted by the Constitution to citizens.A strong youth makes a strong nation;a prosperous youth makes a prosperous nation.The outline of the state plan for Medium-and Long-term Education Reform and development 2010-2020 sets forth the strategic goal of "administering education according to law",and the State has promulgated laws and Regulations on the promotion of Education for Ethnic Minorities and education for ethnic minorities' minors,hunan Province has also issued a series of normative documents,and the Xiangxi Tujia and Miao Autonomous Prefecture has issued autonomous regulations,which have greatly improved the legal protection of the right to education of Xiangxi Tujia and Miao Autonomous Prefecture minors.But the Xiangxi Tujia and Miao Autonomous Prefecture still has some problems in education,such as poor teaching infrastructure,weak teachers,uneven development of education in various counties,and the obvious phenomenon of student mobility,in the area of legal protection,there are problems such as the legislative system needs to be strengthened,the legal provisions are not specific,the system of supervision and relief is not perfect,and the legal consciousness of the subject of obligation is weak,as a result,the realization of the right to education of minors in the Xiangxi Tujia and Miao Autonomous Prefecture is still far from that of other developed regions.As a poor ethnic region,it is worth paying close attention to and studying whether the right to education of minors can be guaranteed in the Xiangxi Tujia and Miao Autonomous Prefecture.Based on the current situation and the actual survey data,this paper analyzes the legal protection of the right to education of minors in the Xiangxi Tujia and Miao Autonomous Prefecture,with the aim of providing suggestions on ways to strengthen the legal protection of the right to education of minors in the Xiangxi Tujia and Miao Autonomous Prefecture,to further strengthen the pertinence and Operability of legal norms.This paper is divided into four parts: the first part mainly introduces the meaning of the right to education and the right to education of ethnic minority minors,and then elaborates the features and protection value of the right to education of ethnic minority minors.The second part mainly from the legal system guarantee and the legal operation guarantee two aspects to the Xiangxi Tujia and Miao Autonomous Prefecture minor right to education legal safeguard present situation elaborates;The protection of the legal system for the Education of minors is elaborated at the level of national law and international law,this paper expounds the present situation of the operation of law from the three aspects of the teachers and the implementation,the law and the supervision,and the results presented by the guarantee of the Xiangxi Tujia and Miao Autonomous Prefecture.The third part points out the main problems existing in the legal protection of the right to education of minors in the Xiangxi Tujia and Miao Autonomous Prefecture.Pointing out that there are problems in the legal system,such as insufficient legislative protection,over-principled legal provisions,insufficient teachers and Facilities Protection,and Unsound Rights Supervision and Relief Protection,the legal consciousness of the subjects of obligation is not strong.The fourth part of the main problems in view of the proposed improvement path.In view of the problems existing in the legal system,the author puts forward the proposal of establishing the Xiangxi Tujia and Miao Autonomous Prefecture.First of all,I believe that although the Xiangxi Tujia and Miao Autonomous Prefecture currently has autonomous regulations,the provisions on education are not clear and well targeted,and there are obvious problems in the legal protection of Education for minors,the right to education of minors has yet to be better realized,the Xiangxi Tujia and Miao Autonomous Prefecture has the right to change laws,and the relevant experience at home and abroad can be used for reference.In order to make the Xiangxi Tujia and Miao Autonomous Prefecture more progressive and prosperous,it is feasible and necessary to formulate regulations;Secondly,it points out that the regulations should adhere to the five basic principles of equality in education,student-orientation,balanced development of education,emphasis on the inheritance of national culture and legalization of poverty alleviation policies,it also points out that the regulations should clarify the rights and obligations,pay attention to the improvement of the quality of education and teaching,strengthen the protection of teachers,pay attention to rewards and punishments and so on.In view of the problems existing in the operation of the law,the author puts forward the improvement of the relevant educational system,and points out that the education law enforcement system and the education supervision system should be strictly enforced,this paper points out that the government,schools,parents and the minors themselves should strengthen the legal consciousness by attaching importance to and perfecting the student complaint system and exploring the Educational Public Interest Litigation System. |
