In recent years,with the continuous improvement of the labor legal system,workers' awareness of safeguarding their rights has been gradually enhanced.At the same time,with the adjustment of economic structure and social reforms,conflict between workers and employers happens all the time as well.The annual number of labor dispute cases in China is high,which poses a certain challenge to the construction of harmonious labor relationship.As a mass organization of the working class,the trade unions has the basic duty to safeguard the legitimate rights and interests of the workers.Under the new situation,trade unions must adhere to the concept of "putting people first and taking the initiative to protect righrs ang interests in a scientific way in accordance with the law",and play a role in safeguarding the legitimate rights and interests of workers,promoting the healthy development of enterprises and building harmonious labor relations.The labor risk assessment of the enterprises in this paper is an innovative means for the trade unions to fulfill the function of labor law supervision and a specific manifestation of the trade unions' performance in safeguarding the legitimate rights and interests of workers.This paper mainly takes Kunshan labor union as the research object to carry out the risk assessment of labor employment in enterprises.This paper analyzes the situation of Kunshan labor union's risk assessment of enterprise labor employment since 2012 through literature analysis,interview analysis,and questionnaire analysis,and summarizes the following problems:First,the effect of the labor risk assessment of enterprises is not obvious;Second,the support rate of enterprises and employees needs to be improved;Third,the relevant mechanism of labor law supervision of trade union needs to be improved.The reasons are mainly reflected in the following four aspects:First,on its own level,the independence of the trade unions is not strong,the shortage of human resources,and team of lack of labor law supervisors of the trade unions is not professional enough;Second,at the enterprise level,the legal consciousness needs to be improved,and the understanding of trade unions is one-sided;Third,at the employee level,the awareness of rights protection needs to be improved,and the distrust of the rights protection of trade unions;Fourth,at the level of institutions and mechanisms,trade unions' lacks legal protection rights function and linkage mechanism for the implementation of assessment results.At last.this paper puts forward some suggestions for the trade union to optimize the risk assessment of labor employment in enterprises:First,on its own level,it is necessary to enhance the work autonomy of the trade unions and strengthen the construction of the cadre team of the trade unions;The second is the level of employees and enterprises,strengthen the positive publicity trade unions,improve the skills of workers;Third,the method level,adhere to the party building belt construction,improve the pertinence of the evaluation system,and seek cooperation with social organizations;Fourth,at the mechanism level,it is suggested that trade unions should participate in the mechanism from the source,improve the democratic management mechanism of enterprises,and improve the consultation and supervision mechanism of labor laws and regulations.The enterprise labor risk assessment involved in this study is an important measure for Kunshan Federation of Trade Unions' to innovate labor law supervision,which is the first case in China.Therefore,it is of certain reference value to carry out this work...
