With the popularity of the Internet,online shopping has developed rapidly in our country,and has been strongly supported and loved by consumers by its advantages of simplicity,speed and low price.However,there are disadvantages of online shopping,consumers cannot access the actual goods,from the purchase to the completion of the transaction can only rely on the introduction of the operator unilaterally,which virtually increases the risk of online shopping transactions.In general,in online shopping,operators need to actively disclose the true information of the goods to consumers,so that consumers can have a comprehensive understanding of the goods and ensure the fairness of the transaction.However,in practice,some unscrupulous merchants often use their advantage position in order to gain benefits to carry out network fraud,false propaganda and other illegal acts to deceive consumers,which not only seriously disturbed the market order,but also brought serious challenges to the legal protection system of the right to know in our country.For the protection of the right to know of online consumers,the current legislation of our country is relatively scattered,the provisions of the law involved in the provisions are not specific,the relevant supporting system is not perfect,cannot effectively protect the right to know online consumers,which will have a certain negative impact on the stable development of online shopping.Based on this social phenomenon,this paper analyzes the basic theory of the right to know of online consumers,and points out the deficiencies in our legislation On the basis of drawing lessons from relevant experiences abroad some suggestions are put forward.I hope I can contribute my own modest strength to the legislative protection of the right to know online shopping in China.In addition to the introduction,this paper is divided into the following four parts:The first part mainly introduces the general theory of online shopping consumers' right to know.On the basis of comparing with the traditional consumers' right to know,this paper analyzes the connotation,characteristics and nature of online shopping consumers' right to know,and expounds the theoretical basis of the existence of online shopping consumers' right to know from the angle of jurisprudence and economic law.The second part summarizes the current situation of the legislative protection of the right to know of online consumers in our country,and through the analysis of the current legal provisions,points out the deficiencies of our legislation in the protection of the right to know of online consumers,mainly because of the imperfect content of the law and the imperfect supporting facilities,which lays a theoretical foundation for the following to seek relevant legal countermeasures.The third part mainly discusses the relevant legislative experience of protecting the right of online consumers to know,studies the relevant legislation of international organizations and representative countries,analyzes the measures taken by different countries on the protection of the right of online consumers to know,and summarizes the experiences and enlightenments that are most suitable for our country to protect the right of online consumers to know.The fourth part is the core of this paper.In view of the deficiencies of our legislation in protecting consumers' right to know,some suggestions are put forward.This paper starts from two aspects,one is to supplement the law itself,to clarify the scope of the right to know,the way to undertake the tort liability and the subject and standard of the obligation of information disclosure.Second,improve the relevant supporting system construction,including credit evaluation system,supervision system and relief system.Through the above two points,to effectively protect the right to know online consumers.
