The Empirical Research On The Power Lists Of Provincial Governments

In 2004,the State Council issued the“Implementation Outline for comprehensively promoting administration according to law”,for the first time,the goal of building a law-based government in about ten years had been proposed.The Fourth Plenary Session of the 18 th Central Committee of the Communist Party of China describes the basic characteristics of a law-based government : power and responsibility are statutory?executing the law strictly?fair and open?honesty and high efficiency ? honesty of obeying the law.So the first requirement of a law-based government is that the organization and the function must be statutory.All the powers of the executive are derived from the law,the government can not do one thing which the law forbid it to do,this is the basic requirment of the law-based administration of government.At the same time,with the development of society and economy,administrative power is expanding all the time during the world,if we don not control the administrative power,it will be harmful for the personal rights.So we must make out a system which can clear the powers and responsibility of the government?make sure the powers work transparently and efficiently.As the result,the list of powers had been came out,it conforms to the reality of our country and a grave attempt to control the administrative powers,it is the outcome of the socialism with Chinese characteristics.The list of the powers had been practicing for almost five years,it has been a great success,it removed a lot of the administrative powers which have no legal basis and can hold back economic development?harmful for the personal rights.It makes the process of the powers more regularly,make sure the responsibilities of the government.Now with the establishment of the E-government and the smart city,the practice of the lists have some new bugs,like too many publishing platforms ?the contents and the structures of the lists are different.And the lists lack of reviewing.To solve these bugs,we need a law to make the content and structure more regular,the maker of the lists should promote their professional ability,building a system of reviewing.Then the list of the powers will be much more better than now.
