Western multinational corporations(MNC)have gradually developed their global sourcing supply chain to China since the 1980 s,and today they have tens of thousands of supply chain companies in China.While these supply chain companies provide products or services to MNC,do MNC pay attention to the laborers' rights and interests protection of their employees and stakeholders? What role does a MNC play in the cause of laborers' rights and interests' protection for Chinese companies?Obviously,this is a realistic and academic issue worth studying.However,after author's search on many academic websites such as cnki.net,the academic community has commented on the individual cases of the laborers' rights and interests protection of MNC companies in China's supply chain enterprises,but with regard to the overall situation of the laborers' rights and interests protection for MNC on their Chinese supply chain enterprises,no one has conducted a special study.Whether a company like a MNC can protect the laborers' rights and interests of its many supply chain employees is the place where people can directly feel the level of human rights and directly benefit from laborers' rights and interests protection.The author has been engaged in the review of the code of conduct for MNC whose laborers' rights and interests' protection in supply chain enterprises in China has been at the core for morethan fifteen years,and she has personally experienced and witnessed the game of laborers' rights and interests' protection between MNC and supply chain enterprises.After the author was admitted to the East China University of Political Science and Law to pursue postgraduate studies,through the rigorous training of legal thinking,under the guidance of the advisor,she made a systematic and in-depth thinking on the game practice of MNC and their laborers' rights and interests protection in the supply chain enterprises in China,and then she drafted the article,as the crystallization of three years of academic work and as a sincere gift of an experienced person to China's reform and opening up for forty years.This article is divided into four chapters.The first chapter focuses on the laborers' rights and interests protection standards established by Western MNC for Chinese supply chain enterprises,namely,“contractual”,“cooperative” and“conventional” laborers' rights and interests' protection auditing standards.The second chapter introduces the audit process of Western MNC on laborers' rights and interests' issues in Chinese supply chain enterprises.There is a general audit process,including notification form,auditor conditions,audit methods,steps and result classification.At the same time,it analyzes the shortcomings of the general audit.The author has introduced a series of examples and introduced measures to follow up supervision and synergy improvement.The third chapter describes the game practice of MNC and laborers' rights and interests protection practices in supply chain enterprises in China and reveals some of the processes of running-in and evolution,which are between internal auditors or their assigned third-party auditors and audited factories,between the MNC business unit and the supply chain factory(the audited factory),between the third party auditor and the MNC,and between the local government's pursuit of taxation and employment and the audit standards of laborers' rights and interests of the MNC corporation.Above all indicate that the advancement of the cause of laborers' rights and interests is the product of various struggles.In the fourth chapter,the author analyzes the reasons why Western MNCs pay more attention to laborers' rights and interests' protection of their Chinese supply chain enterprises from both the internal and external aspects.External factors are mainly thepressure of consumers,investors,international organizations,media public opinion and litigation against MNC.The internal factors are mainly the social traditions that attach importance to human rights since the Western Renaissance;the progress of the laborers' rights and interest's concept of corporate management;the enhancement of corporate employees' rights awareness and the corporate consideration of long-term business strategies.In the final "conclusion" part of the thesis,the author puts forward four problems that MNC has in terms of laborers' rights and interests protection in their supply chain enterprises,including transparency and fairness in laborers' rights and interests audit,the issue of the binding force of MNC on the laborers' rights and interests protection of supply chain enterprises 2nd tier,the mechanism of labor audit of MNC,and the standard issues.Finally,based on the game practice of MNC and the protection of labor rights and interests of supply chain enterprises in China,the author puts forward sincere suggestions on how to pay attention to the protection of laborers' rights and interests in the overseas investment development of Chinese enterprises.Chinese companies that “go global” should be aware that if there is a lack of a mechanism for consultation with overseas stakeholders on the rights and interests of workers,and lack of sufficient attention to these issues,it will be possible for Chinese companies to be faced with tremendous pressure and challenges.In order to cope with these more and more challenges,companies can formulate their own labor policies,from the corporate strategy,pay attention to the responsibility of respecting the rights and interests of workers,and systematically identify potential protection risks in products and services,so that respecting and protecting the rights of workers has become the daily behavior of enterprises.The effective practice of MNC in the process of promoting the protection of labor rights and interests of Chinese enterprises will undoubtedly have a positive reference for Chinese enterprises to go global.We must work hard to avoid some people's criticism and malicious attacks on Chinese enterprises in terms of labor rights and interests,and establish a good image of Chinese enterprises paying attention to the protection of workers' rights and interests.
