A Study On The Development Of Rights In The Reconstruction Of Villages In Cities

Urban village is a relative product in the process of urbanization.It is located within the scope of urban planning or at the junction of urban and rural areas surrounded or semi-surrounded by the urban built-up area,and has no or only a small amount of land.It is a non-urban non-rural settlement form between the city and the countryside.There are complex social relations and social problems in the urban village,which will affect the future of the city.Therefore,the urban village reconstruction is not only the reconstruction of geographical space,but also the reconstruction of urban social space.After the reconstruction,it is worth considering where the urban village residents go and whose city they live in.Based on such thinking,this study takes the development of subject’s rights in the urban village reconstruction as the research question,and makes an in-depth analysis of the urban village reconstruction in shenzhen.The reason why the author choose the urban village in shenzhen as the research object is that shenzhen is a city developed from a small fishing village,and its urban growth history is the development history of the urban village.Compared with the urban village reconstruction in other cities,the urban village reconstruction in shenzhen is more typical.Through the field investigation,the author finds that there are many rights conflicts in the process of urban village reconstruction in shenzhen.In order to deeply analyze these problems,the author constructs a theoretical analysis framework on the basis of urban function theory,social space theory and urban rights theory,and analyzes the internal logic of urban village reconstruction with relevant cases.Specifically,this study follows the following research ideas: chapter one constructs an explanatory framework on the basis of space and rights through theoretical review,in which space is the place of action for urban village reconstruction,rights are the strategic basis for urban village reconstruction,and urban village reconstruction is the reconstruction on the basis of space and rights.After the completion of the theoretical framework construction,the second chapter goes back to the practical level,deeply analyzes the spatial form and spatial value of shenzhen urban villages,and finds that with the geographical space and social space structure of urban villages,the individual right consciousness of urban villages gradually awakens and urban rights germinate.The third chapter and fourth chapter is to analyze the urban villages space rights conflict problem in the process of renovation.The third chapter analyzes the top-down transformation process of urban village on the basis of case,and finds space transformation is a process of space production.Under the effect of space production,city rights be allocated and the gap of rights is gradually widened.The fourth chapter analyzes the issue of rights protest in the process of urban village reconstruction.Through analyzing the causes,process and results of rights protest by combining three cases,it finds that there is a bottom-up route of rights protest in the process of urban village reconstruction.The fifth chapter goes back to the level of “should be”,thinking about how to solve the problem of rights in the process of urban village reconstruction.It proposes thatthe urban village spatial reconstruction must be carried out in the urban development,and the balance of urban rights should be maintained through the protection and development of rights.The essence of urban village reconstruction is the return of urban space justice.To achieve a city which has a sustainable development,we must keep the value pursuit of justice and adhere to the symbiosis with urban villages.In the process of urban village reconstruction,we ought to focus on space and time,pay attention to the development of stock and pay attention to cultural protection,and respect the rights of every resident village inside city.Only in this way we can realize the balance of rights and power,space and balance,and build a right community in the city.
