An Empirical Study On The Operation Of Compulsory Isolation And Detoxification Measures

At present,there are nearly 2.553 million registered drug addicts in China,which is estimated to be about 1:5 according to the international practice(that is,for every explicit drug addict,there are 5 hidden drug addicts),and one out of every 100 people is a drug addict on average.Responding to the severe condition,our country successively introduced the drug laws of the People's Republic of China "(hereinafter referred to as the" drug laws ")and the drug regulations,the two laws and regulations established compulsory isolation detoxification to replace the previous compulsory drug addiction rehabilitation and the defect of reeducation through labor rehabilitation,reflects the people-oriented and pay attention to drug treatment for the idea,pay more attention to integration of drug resources,improving detoxification effect.This article through to our country,the essay discusses the basic theory of compulsory isolation measures,on the basis of comparison of other countries and regions of the compulsory drug addiction rehabilitation model,further isolation compulsory rehabilitation centers and compulsory isolation detoxification measures related department for empirical research,data collection,find our country compulsory isolation detoxification measures the main problems existing in practice.Then,through the analysis of the causes of the problems,and then put forward Suggestions to improve China's compulsory isolation detoxification measures.It is hoped that this study can contribute to the reform of compulsory isolation and detoxification measures in China and contribute to the drug control cause in China.The text is divided into four parts.The first part is an overview of compulsory isolation and detoxification measures.Based on the analysis and understanding of the concept and legal attribute of compulsory isolation and detoxification,this paper expounds its characteristics of compulsion,closure,punitive,education and correction.The second part is the empirical investigation of the operation of compulsory isolation drug rehabilitation measures.Conduct research and analysis,consult documents,collect data and interview relevant personnel in D city's compulsory isolation drug rehabilitation center and E city's compulsory isolation drug rehabilitation center;In-depth investigation and analysis were conducted by the public security department and judicial department of D city,which are related to compulsory isolation and drug rehabilitation measures.Data were collected and problems were found in the decision-making process,public security and judicial compulsory isolation and drug rehabilitation centers,follow-up care and other links of compulsory isolation and drug rehabilitation measures.Then these problems are summarized as follows: first,the public power is too large;Second,it is difficult to protect the rights and interests of drug addicts.Third,the connection between public security and judicial departments is not smooth;Fourth,follow-up care is weak.The third part is the cause analysis of the operation of compulsory isolation drug rehabilitation measures.This chapter mainly analyzes the causes of the obstacles in legislation,law enforcement and follow-up care of compulsory isolation and detoxification measures,analyzes the underlying causes,and provides guidance for improving.The fourth part is the suggestion of perfecting compulsory isolation and drug rehabilitation.In view of the above main problems in the operation of compulsory isolation and drug rehabilitation measures in China,the author investigated the compulsory rehabilitation modes in many countries and regions,and obtained some experience and enlightenment,providing reference for the improvement of compulsory isolation and drug rehabilitation measures in China.Then,the Suggestions for the improvement of compulsory isolation and drug rehabilitation measures in China are elaborated: First,in terms of the legislative system,it is suggested to perfect it by re-establishing the power of law enforcement,straightening out the relationship between forced isolation and other drug rehabilitation modes,and introducing the judicial criminal trial procedures.Second,in terms of operation,it is suggested to improve the identification,relief procedures and admission standards of drug addiction.Third,in terms of supporting system,it is suggested to improve the system from the aspects of law enforcement supervision,the protection of the basic rights of drug addicts,the professionalization of law enforcement team and the construction of facilities.Fourth,in the follow-up care,it is suggested to improve the employment and entrepreneurship of drug addicts through government intervention,participation of social welfare organizations and help.
