| The Belt and Road is of great significance to the development of China and the world,so construct the China's international anti-terrorism law system,to ensuring the security of the Belt and Road is an important issue in China's international cooperation.It is necessary to construct the China's international anti-terrorism law system,at present,In the areas along the Belt and Road,terrorism exists in Europe,Africa and Asia,especially in West Asia and Africa.Terrorist forces even have the ability to counter government armed forces,terrorism poses a major security threat to human society.In particular,terrorist armed forces such as ISIS,which have appeared in recent years,.In the areas along the Belt and Road,terrorism exists in Europe,Africa and Asia,especially in West Asia and Africa.Terrorist forces even have the ability to counter government armed forces.And the terrorist forces in China for a long time are also active in the Belt and Road cooperation area.To maintain the security of the Belt and Road cooperation area,we must rely on armed forces to cross-border counter-terrorism.It is Feasible to construct the China's international anti-terrorism law system,in legal theory,it is justified for China to construct the international anti-terrorism law system.According to United Nations documents and international theory,the use of armed forces to cross-border combat terrorism is in accordance with international law.In domestic law,China's Criminal Law considers terrorism to be a violent crime that seriously endangers national security;China's Anti-Terrorism Law stipulates that the People's Liberation Army of China and the Chinese Armed Police Force have the responsibility to fight terrorism across borders.Therefore,if China can rely on the advantages of armed forces,establish China's international anti-terrorism law system,with related countries to combat terrorism,and ensure the security and stability of the Belt and Road cooperation area.In the Belt and Road cooperation area,establish China's international anti-terrorism law system.It is also necessary to learn the experiences of countries and international organizations in the construction international anti-terrorism law system.Among international organizations,the European Union and the Shanghai Cooperation Organization both use international platforms to formulate various international cooperation documents on counter-terrorism,and require member states to improve their national laws in accordance with international agreements.International counter-terrorismcooperation among member states and even sending armed forces to implement overseas Counter-terrorism mission.The United States and Russia participate in regional organizations to ensure regional security,and send armed forces to conduct military operations overseas,to combat terrorism;and to improve domestic anti-terrorism laws.So China should to absorb the experiences of the United States,Russia,the European Union and the Shanghai Cooperation Organization,and put forward proposals for the construction of China's international anti-terrorism law system.When establish China's international anti-terrorism law system,China should first abide by various legal principles,including basic principles such as respect for national sovereignty,respect and protection of human rights,and international cooperation.Second,through international cooperation,in particular to deepen cooperation with the SCO and the European Union and ASEAN,and sign bilateral or multilateral anti-terrorism cooperation treaties with countries participating in the Belt and Road.On this basis,China should sign military cooperation agreements with countries that cooperate with the Belt and Road Initiative,sign intelligence cooperation agreements with them,and increase the strength of its armed forces to enable them to fight against militarized terrorist forces.The countries that cooperate with the Belt and Road Initiative signed military agreements for the dispatch of armed forces to enable the armed forces to carry out cross-border counterterrorism operations overseas.And China should establish a leading agency and dispute resolution system for China's international anti-terrorism law system,to solve various problems arising from cross-border counter-terrorism.Finally,China needs to improve the domestic anti-terrorism legal system,especially to strengthen the degree of fight against terrorism in Criminal Law,and to improve the provisions of the Anti-Terrorism Law for sending armed forces out of the country.so that China can participate in international anti-terrorism orderly and legally. |
