Research On Anti-Terrorism Cooperation Under The Framework Of "The Belt And Road"

With the deep development of the "Belt and Road" initiative,the areas along the route have become the focus areas of international terrorism and the infiltration of extremist forces.In order to fully implement Xi Jinping theory of anti-terrorism in the new era,provide a safe and stable development environment for "the Belt and Road ",and realize the common goal of universal security,under the guidance of the concept of "building a community with a shared future for mankind" and " Correct view of benefit and righteousness ",we should strengthen counter-terrorism cooperation under the framework of "the Belt and Road ",maintain the pluralistic and orderly development of regional counter-terrorism mechanisms,and perfect the relevant legal system of Anti-terrorism Cooperation,promoting the effective convergence with the international rule of law against terrorism,so as to form a joint force to combat terrorism with the participating countries of "the Belt and Road " at the legal level,has become the objective and realistic demand of the sustainable construction and development of the "the Belt and Road " initiative.This paper is mainly divided into the following five parts:The first part "introduction" mainly introduces the research significance,research status,research methods and innovation points of this paper.The second part,"Overview",through the study of the situation of terrorism in the areas along the route,shows that the primary task of the current anti-terrorism cooperation is "anti-extremism" cooperation;Dominant interests of great powers and double standards of measurement are the present situation of the current counter-terrorism cooperation;The difference of cooperation concept,the imbalance of the level of rule of law and the generalization of anti-terrorism measures are the legal dilemmas faced by anti-terrorism cooperation along the route.At the same time,it is also the macro reason for the lack of effectiveness of anti-terrorism cooperation along " the Belt and Road " route.The third part selects representative regional organizations according to the region,combs their legal mechanisms of counter-terrorism cooperation one by one,and finds that the rules or rules system of regional counter-terrorism cooperation are relatively autonomous,lack of links,and show the phenomenon of "fragmentation".At the same time,criminal justice cooperation is still immature compared to cooperation in the law enforcement and administrative fields.This is also a specific reason for the lack of effectiveness of anti-terrorism cooperation along " the Belt and Road ".The fourth part starts from the point of view of the international response to counter-terrorism cooperation under the framework of "the Belt and Road " in our country,through the implementation of the principle of sovereign equality and the principle of measuring legal interests,reflects the "subjectivity" of countries along the route in anti-terrorism cooperation.Using the Vienna Convention on the Law of treaties,coordination among regional organizations and the principle of national consent to alleviate the "fragmentation" of anti-terrorism legal norms in the regions along the route.Promote the development of preventive measures of anti-terrorism cooperation,strengthen the exchange of information,jointly investigate and crack down on related behaviors and strengthen financial regulatory cooperation,so as to lay a good foundation for the formation of a rule of law governance system for anti-terrorism cooperation under the framework of "the Belt and Road ".The fifth part is from the "Belt and Road" framework under the requirements of China's anti-terrorism legal system perfect point of view.Legislatively,the measures of "de-extremism" are refined to pave the way for "de-extremism" cooperation with participating countries;Prevention of "preventive" risk provides "Chinese wisdom" for generalization of anti-terrorism measures.Judicially,by improving the legal norms on the extradition of terrorist criminals in our country and ensuring the application of the International Criminal Mutual Legal Assistance Law in the field of counter-terrorism,we can lead participating countries to carry out more cooperation in the field of counter-terrorism justice.
