Research On Legal Adjustment Of Bike Sharing Service Transaction Risk

The new form of "sharing economy" is a combination of cloud computing,big data,broadband networks and smart terminals.The sharing economy service model transforms traditional ownership thinking into use thinking and sharing thinking.Scholars believe that the sharing economy is an economic activity,and the specific way is to share goods and services among non-commercial subjects.The main medium is the social network platform.Its service model is an innovative business model developed in recent years.Because it is very different from the traditional economic model,the existing rules cannot be used directly.At the same time,in the development process of the sharing economy service model,risks and regulatory dilemmas are constantly emerging,so the need for risk diversification and transfer of the sharing economy service model makes it very important to research on legal adjustment of bike sharing service transaction risk.In the sharing economy service model,shared travel modes such as bicycle sharing,online car sharing,and car sharing are the sharing economy transaction methods that we often come into contact with.The topic of this article is based on the shared travel method of bicycle sharing as an example.I hope that through case analysis and The data sorting method can clarify the development status and legal relationship of the bicycle sharing service model,and find out the current risk patterns and responsibilities of the bicycle sharing service model from the case.With the purpose of diversifying the risks of the bicycle sharing service model,this paper analyzes the legal and regulatory system of bicycle sharing service model,draws on the legal regulations of shared travel methods in other countries,and puts forward suggestions for legal adjustment research on the risks of bicycle sharing service transaction.The analysis and construction help to diversify the risks of travel mode s in the sharing economy service model,and provide a regulated and guaranteed environment for bicycle travel risks under the sharing economy.This article attempts to answer three questions.First,what are the transaction characteristics of the service model of the sharing economy,what is the risk pattern of the transaction model,and how is legal liability divided? Second,the shared bicycle service model in shared travel What dilemmas arise as a typical service model,how to design its trading relationship and risk sharing,and how does its transaction model risk occur,and third,how to adjust the laws on the legal regulation of shared bicycles,and where are the advantages and reasons for legal adjustments?.This is the writing idea of this article,and it is also the logical structure and the problem to be solved.It should be noted that the sharing economy is an economic form,and what this article deals with is a realistic problem from the legal perspective in the sharing economy service model under the sharing economy environment.This article comprehensively uses relevant theories such as law and economics,and uses a combination of theory and empirical research,comparative analysis,literature research,and case studies to learn from various methods.It analyzes the legal problems existing in the process of sharing bicycles under the conditions of the sharing economy and Transaction risk,drawing on the laws and regulations of the United States,Japan,and Europe on shared travel modes,adopting a comparative study method,and combining with China's actual conditions,we hope to strengthen the relief of legal risks through legal adjustments such as design a shared bicycle compulsory liability insurance and promote the healthy development of the sharing economy service model.
