In recent years,shocking minors' school bullying have appeared on the Internet.School bullying has gradually entered the public eyes and has begun to attract attention and vigilance from all walks of life.Once upon a time,school bullying was once regarded as a "joke" or "prank" between children.It was unknown that the so-called "prank" had brought great harm and irreparable trauma to the bully,and even caused victims.Serious consequences such as suicide.Junior high school students are in the transitional period from children to adolescence,which is a critical period for their personality and habits.Students in this period are not mature enough,are prone to emotional fluctuations,have poor self-control ability,and often have no regard for the consequences of incidents lead to bullying.However,because students at the junior high school stage are mostly twelve to fifteen years of age,they are at the age of no criminal responsibility and relative criminal responsibility.When a vicious campus bullying incident occurs,it is difficult to investigate the criminality of the bully according to the Criminal Law and other relevant laws.Responsibility,In this context,the legal regulation of campus bullying at this stage is very important to prevent the problem of campus bullying.Campus bullying research in China started relatively late.Until 2007,there were few articles on campus bullying in the Mainland China,and research on this issue began to increase in 2016.The concepts related to school bullying are not clearly defined,and there is no specific legislation and related supporting measures to deal with school bullying.Scholars and all sectors of the society should be held criminally responsible for malignant school bullying and reduce the age of criminal responsibility for minors.Many views such as whether the current criminal alternative measures are effective are controversial.Therefore,the author uses the Peking University magic law case as the main line,combined with relevant investigations,and conducts a sample survey with the students of junior high school in Kunming A School in Yunnan Province as the background to understand the current situation of bullying in junior high schools,including the frequency of bullying,bullying methods,and junior high students Deal with bullying,school and parents,and analyze and analyze data.According to the survey results,in today's increasingly serious school bullying,the problem ofmanaging school bullying should not just stop at the level of school education and family supervision.Instead,school bullying should be incorporated into legal regulations,the concepts of campus bullying should be clarified,and the current school bullying in China should be faced with the law.Govern the dilemma and take measures from the four levels of legislation,justice,law enforcement,and legal awareness to cope with bullying on campus.
