Study On The Legal Protection Of The Health Information Of The Elderly In The Smart Old-age Mode

With the rapid development of various industries under the background of "Internet Plus",the intelligent old-age model of big data technology has emerged in the old-age industry.At present,our society is facing the serious problem of aging phenomenon,the number of empty nests,living alone elderly people is increasing,while the demand for old-age care is also increasing.However,because China's old-age service industry is still in the development period,the number of old-age institutions is seriously inadequate,bed allocation is relatively low,so a large number of elderly people do not want to go to the old-age institutions for old-age care.Also at this stage,the elderly population consumption capacity to improve,the government is also vigorously advocating and promoting the development of the elderly industry,so,the smart old-age model has become the inevitable choice of the elderly in modern society.The development of the intelligent old-age model relies entirely on the collection and use of big data,through the collection of various body information of the elderly,to provide the elderly with a full range of daily life services.In the face of China's current legislation is not yet perfect information protection system for the elderly,so a large number of information for the elderly is collected,in fact,will make everyone doubt the security of information.Therefore,in the face of the protection of health information for the elderly in the medical field,we can improve the protection system which is not perfect in our country by reference to the more complete way of personal health information protection abroad.This paper first introduces the definition and characteristics of personal health information in the smart old-age model,briefly explains which personal health information will be collected in this old-age model,and how to be collected and how to be used.And introduced the intelligent old-age model of the elderly health information compared with the past traditional health information of the elderly,so as to highlight the big data environment of the elderly health information in the protection and utilization of contradictions,so it is necessary to more adequate legislation to protect it.And combined with the typical country's personal health information protection system,to analyze,summarize,try to find the principle and path of personal health information protection in different countries,to find suitable for China's elderly health information protection ideas.Finally,after analyzing the shortcomings in China's current health information protection legislation for the elderly,we should improve the application of the principle of informed consent in legislation,and build a comprehensive system of health information protection system for the elderly by three aspects: judicial relief,supervision mechanism and awareness of the protection of the elderly.
