Personnel agency system is a management style of human resource which has been carried out actively in China after the establishment of socialist market economy,along with the reform of personnel affairs in state-owned enterprises and institutions.It was put forward formally by the National Ministry of Personnel in 1995,and then started the course of development for more than 20 years in its attempt.Although China strongly supports the implement of personnel agency system in policy,some achievements have been made as well,however,due to various reasons,especially the vague functional orientation,the imperfect legal system,and the low social acceptance,severely affect it to fulfill its function as supposed.So,how to improve and regulate Chinese personnel agency system? Dividing into five chapters,this paper studies and draws a conclusion.Chapter One is an introduction contains the background,significance,contents and methods of this study,then separately summarizes the current research situation of Marxist human-oriented thought and personnel agency system both at home and abroad.Chapter Two clarifies the connotation of personnel agency system from narrow and broad aspects at the beginning.Afterwards,it concludes four characteristics which are known as being modernized,socialized,professional and contractual.Next,this part analyzes the legal relationship of personnel agency system by means of discussing whether it conforms to entrusted agency from the perspective of civil law.At last,this paragraph points out that Chinese personnel agency system contains abundant Marxist human-oriented thought.It respects and liberates talents' social property,helps them balance their personal and social value,achieve free and comprehensive development.Chapter Three reviews the historical process of pursuing personnel agency system in China.It generalizes those periodical changes in different stages according to the timeline,and comes to the conclusion that the birth and perfection of Chinese personnel agency system are deepened gradually following the reform of national personnel system,at the same time,taking the maturity of talent market as the main sign.Later,this thesis lists the practice of personnel agency system in domestic universities,banks and hospitals,thus outlines the necessity of promoting it in enterprises and institutions.Chapter Four dissects the problems of Chinese personnel agency system from three categories: the capability definition is ambiguous,the legal system is not sound,the social identity is weak.The major ideas are as follow: talent service agencies are limited to operate records management in a long period of time and usually lag evidently,it's hard to balance efficiency and fairness under the double-track system of employing at present,China has not yet enacted special legislation of personnel agency system,the labor contracts which are signed by employers and workers lack specification in most cases.In addition,the unreasonable household registration policy for personnel agency,the difficulty of becoming a full member,the phenomenon of same work with different pay,together increase the outflow of talents.There are several causes for the above situation: Chinese talent market develops slowly,the traditional view of steel-bowl is deep-rooted,and personnel agency system is in a comparative lack of legal protection.Chapter Five gives some consideration of improving Chinese personnel agency system,claims that we should stick to the guiding role of Marxist human-oriented thought,enhance the degree of recognition and acceptance in the whole society,build the jurisprudence of personnel agency system in our country.Detailed assumptions include that the introduction,management and cultivation of talents must adopt the principle of equity,openness,flexible flow,and integrated development.Employers and agencies ought to define the responsibility of personnel agency for each other and make a good connection.Talent service agencies shall strengthen self-construction in order to improve its level and quality of service.Enterprises and public institutions have to transform all the established notions,and try to treat staff in a fair way no matter they are regular-authorized workers or not.Government departments are obliged to standardize labor contracts for personnel agency,perfect relevant laws and regulations.
