Teachers' disciplinary power is a kind of power peculiar to teachers' professional identity,and it is the power to punish students according to law.However,Chinese laws do not explicitly endow teachers with this power,so teachers' disciplinary behavior will be questioned by parents and the outside world.However,discipline is an essential education method in the process of education.It is complementary to appreciation education to promote the overall development of students.However,teachers' discipline must be moderate.This study adopts questionnaire survey method and interview method.Type is according to the physical punishment,psychological punishment,material punishment disciplinary four dimensions and activity type questionnaire,this research has designed two questionnaires: one is the exercise of the reasonable range of the right of primary and secondary school teachers disciplinary investigation questionnaire,for primary and secondary school teachers,students and parents,a total of 800 questionnaires,748 valid questionnaires taken back;The second is the questionnaire on the implementation status of punishment power of primary and secondary school teachers,in which 200 questionnaires were distributed and 197 valid questionnaires were collected.In the interview method,the author interviewed three teachers and three students.This study finds that the primary and secondary school teachers' misconduct in punishment includes: First,punishing students for labor,and students' aversion to labor.Second,it violates students' right to education by throwing them out of class.Thirdly,detention after school is punished to restrict students' personal freedom.Fourth,the punishment public review or the apology,injures the student self-esteem.Fifth,the fine,violates the law the stipulation.Sixth,punishes buys the daily necessities for the class and grade,the disguised increase student's burden.Seventh,deprive the qualification that participates in class break activity,affect student study efficiency.Eighth,the denial of the qualification to participate in physical education class,hinders students from exercising.Next,based on the interview content,the author explores the reasons for the improper punishment of primary and secondary school teachers in the following aspects: First,the social aspect: the misguidance of public opinion.Secondly,the government level: the absence of relevant laws on teachers' disciplinary power.Third,the school level: the school rules and regulations flaw and the school legal system education flaw.The fourth is the level of teachers: teachers' cognition of punishment and corporal punishment is vague,their legal knowledge is weak,and their mistakes play a role in labor.This study proposes the following countermeasures for the reasonable scope of teachers' disciplinary power: First,the society should provide a healthy public opinion environment and publicize the positive effects of teachers' disciplinary power.Secondly,the government should improve relevant laws on teachers' disciplinary power and establish supervision and relief mechanisms.Thirdly,schools should improve the legal literacy of teachers and students and regulate teachers' disciplinary behaviors.Finally,the teacher must establish the correct labor view,respects student's privacy and the self-esteem.
