As an educational means,educational punishment comes into being with educational activities.However,with the development of the concept of people-oriented and appreciation education,educational punishment has gradually become a controversial topic.In recent years,social events caused by educational punishment have been increasing,and the problem of vague or loss of teachers' educational punishment right has returned to the public view,which has attracted much social attention.From the perspective of external conditions,as a new rule,teachers' educational punishment right urgently needs the scientific standardization of national laws and regulations;From the perspective of the implementation subject,a reasonable understanding of their own educational punishment right is the key for teachers to effectively execute their educational punishment right.On March 1,2021,the “Primary and Middle School Education Punishment Rules(Trial)” was officially implemented,which made it clear that elementary and middle school teachers have the right of education punishment,and described in detail the situation in which teachers can execute the right of education punishment.But in front-line teaching practice,how is the implementation of the rule? What understanding and attitude do elementary and middle school teachers hold towards the right of educational punishment? What problems exist in the executive process? What kind of dilemma are you facing? What factors will affect the execution of the right of education punishment? These problems need to be studied and solved in this thesis.This research mainly adopts literature method,questionnaire method and interview method,and adopts paper questionnaire and network questionnaire to cross-verify the research.From two perspective of teachers and students,the design of five dimensions(primary and secondary school teachers' cognition and attitude towards education and punishment,primary and secondary school teachers in the implementation of the present situation of the disciplinary education,primary and secondary school teachers on the basis of the right to education and punishment and situations,primary and secondary school teachers education disciplinary effect and the influence factors of the right to education disciplinary primary and secondary school teachers)to investigate,In order to understand objectively and comprehensively the status quo of teachers in primary and secondary schools exercising the power of educational punishment.The study found that the problems of primary and secondary school teachers in the exercise of the power of educational punishment are mainly reflected in four aspects: first,schools are not in place to formulate and implement the rules;Second,teachers have cognitive deviation and arbitrary punishment;Third,there is a deviation in the guidance of media opinion and parents' understanding;Fourth,the implementation effect of educational punishment has not reached the ideal expectation.In view of the problems and root causes found,this paper puts forward the following strategies to promote primary and secondary school teachers to exercise the power of educational punishment more reasonably and effectively through discussion: First,improve the school management system,educational punishment rules to follow;Second,improve the comprehensive quality of teachers,educational punishment targeted;Third,promote home-school cooperation and exchanges,with strong support from education and punishment.Fourth,to optimize the environment of public opinion,there are examples of educational punishment.
