In modern Chinese educational ideas,the idea of praise and reward as the main,and criticism and punishment as the supplementary,is deeply rooted in people's hearts.With the promotion of curriculum reform,"appreciation education" is even more popular.In addition,in recent years,parents and students have gradually increased their awareness of their rights,the power boundaries of teachers in student management urgently need to be clarified,the right of teachers to punish and punish is in a state of controversy in academic theory,and the legal principle still lacks effective protection of the right to discipline.Under various factors,There are many problems in the exercise of the disciplinary power of our teachers.From the existing research results on teachers 'disciplinary rights,we have studied the disciplinary rights of teachers abroad for many years and made considerable achievements.We have formed a certain system and ensured its implementation in the form of legislation.For example,the exercise of discipline rights by teachers in the United States,the United Kingdom,France,Germany,Spain,Singapore,South Korea,Thailand,Japan,Australia and other countries has important reference value.Domestic scholars mainly discuss the theoretical aspects of teachers 'disciplinary rights.Including the definition and analysis of teachers 'disciplinary rights related concepts,the rationality of teachers' disciplinary rights,the necessity of teachers 'disciplinary rights legislation,the structure of teachers' disciplinary rights legislation,and the exercise of teachers 'disciplinary rights.As a result,teachers exercise the principle of discipline and discipline,from the aspect of supervision and relief to put forward suggestions for improvement.In general,the research results are rich,but they are fragmented,the proposed strategy is unknown,and the empirical research is insufficient.Therefore,this paper uses literature research method,questionnaire survey method,interview research method to carry out the research,through combing and summarizing the existing literature results,in-depth investigation of the case of school teachers disciplinary rights,in the hope of a new breakthrough.This article analyzes from five aspects: disciplinary subject,disciplinary object,disciplinary method,disciplinary process,and disciplinary effect,and summarizes the problems existing in the application of disciplinary power of teachers.It is found that teachers face difficulties in the exercise of disciplinary power: as the subject of disciplinary power exercise,teachers have unclear concepts of discipline,different standards of disciplinary exercise,easy transfer of disciplinary rights,and arbitrary attitude toward discipline;As the object of punishment,the student's deviant behavior has the situation that the object is misplaced and the object is unknown;The method of teacher discipline is old and rigid,and the punishment is too rigid;The disciplinary process lacks standard and the process is too simple;In the end,there was a certain disciplinary effect,but it also attracted students 'resentment and parents' confusion.There are many reasons for the problems in the exercise of teachers 'disciplinary rights.The author tries to analyze from nine aspects: the reasons of laws and regulations,the reasons of supervision and relief,the reasons of teachers themselves,the educational mechanism,the reasons of public opinion,the educational mechanism,the parents,the students,the teacher-student relationship,and the home school relationship.Then accelerate legislation from the state to protect teachers 'disciplinary rights;Schools are fully established and teachers 'discipline is standardized;Teachers transform themselves and improve the disciplinary effect of teachers;Science and technology to create a platform to optimize the implementation of teacher discipline these four levels give some strategic ideas,hoping to help teachers exercise disciplinary power.
