“Managing education by laws” is the only way to solve the existing problems in educational governance.The latter helps ensure that people can have the right to a higher level of education,while the former guarantees people's rights to education.A system of legalization in school governance is a solid foundation for educational legalization,and also a significant premise for realizing educational modernization.The Education Law of the People's Republic of China explicitly states that there should be institutional frameworks and constitutions in place when schools or other educational institutions are set up.According to the constitution,schools should have autonomy to run themselves.The school's constitution must be built into the school's governance system in terms of national law.Academic research on the constitutional construction of primary and middle schools often shows that the school constitution is deemed as the campus law,and also the institutional basis for scientific,standardized and democratic school management.This not only shows that there is a fundamental understanding of the school constitution's legal status,but it also highlights the important role in promoting the idea of “managing schools by laws”.This paper is aiming at primary and middle schools in H City,and it carries out in-depth analysis and research into the constitutional construction of primary and middle schools across the whole city.It looks at the use of literature,questionnaires,interviews,surveys and text analysis in a comprehensive way.Relevant analysis and research have found that there are problems with many school constitutions: they are insufficiently managed and have inadequate support.There are also problems with a lack of standardization in the procedure of drawing up a constitution,and there is a strong dependence on the heads of administrative departments to draw up relevant laws.Staff members have an inconsistent understanding of the school constitution,or view it as having a limited role.Following in-depth analysis into these problems,the following can be concluded: the legal status of the school's juridical person is insufficiently protected;administrative departments are too centralized;it cannot be guaranteed that the school is run autonomously;many have not recognized the school constitution as fundamental documentation,and also a legal guarantee;there is a lack of recognition that the school constitution limits the power of all parties concerned with the school.Alongside this research,the author puts forward some suggestions and countermeasures for improving the constitutional construction of H City schools in terms of educational system reform,government-school relationship straightening,and popularization of educational laws,and practical measures for constructing a school constitution.The author provides some theoretical evidence and practical experience with a view to improving the constitutional construction level of the primary and middle schools in the city,and offers some humble advice on how to speed up the process of managing schools by laws.
