With the advent of the “Internet + Transportation” era,ride-hailing industry is booming around the world.Less than four years have passed since its launch,it has already significantly changed the transport mode of our life.Until the end of 2017,the market penetration rate of ride-hailing mobile app has reached 14.0%,and the market size has exceeded 140 million.Ride-hailing industry,as the product under the era of sharing economy,has promoted the effective allocation of market resources.At the same time,its appearance has eased the difficulty in urban public transport to a certain extent,provided diversified transportation method and offered new jobs and opportunities.In addition,the appearance of ride-hailing cars has also altered the long-term monopoly position of the traditional taxi industry,which has brought much impact about revolution on the taxi market.As a company based on Internet,ride-hailing app company has the dual nature of Internet companies and traditional companies.To explore the effectiveness of the ride-hailing company legislations,how to define it is particularly important for the risk and responsibility allocation.Based on the legislator's intentions,the related domestic and foreign judgments,and relevant laws,it is mostly appropriate to define a ride-hailing company as a transport carrier.On July 28,2016,the Ministry of Transport formally issued the Interim Measures for the Administration of Online Taxi Booking Business Operations and Services,which has legalized ride-hailing industry.Interim Measures outlines theregulations concerning the ride-hailing companies,the vehicles and the drivers.However,the excessively stringent driver and vehicle qualification requirements in some local regulations have led to controversy.With the purpose of effectively controlling the number of private vehicles to reduce traffic pressure and protecting the traditional taxi market,and indirectly controlling the population in big cities,these regulations have caused adverse impact on ride-hailing companies' operation,which ran against the purpose of this industry.The development and regulations of ride-hailing industry in foreign countries might be used as reference.It can be found that the regulatory attitude of government mainly depends on the comparison of the strength with traditional taxi industry,the development level of the Internet economy,the current status of urban traffic congestion,and political orientation.At present,the government support on ride-hailing industry is a major trend.By studying the regulations in foreign countries,the current stringent regulations in China may not be able to solve the problems faced the industry.However,due to the situations in different countries,it is not a wise choice to completely copy the regulations in foreign countries.Meanwhile,in order to achieve a better ride-hailing market,the focus of regulators should be shifted,mainly focusing on the supervisions of the ride-hailing platforms.In addition to the existing controversial issues in the current legislation,the ride-hailing market is also facing updated new challenges.The data security of the ride-hailing platform has exposed many problems.Despite the existence of a relatively complete data protection legislative mechanism,the government departments lack the effective supervision methods to deal with the exact problems.In addition,the dominating status of Didi has also triggered the suspicion of monopoly.It is yet waited to be further regulated to promote the enthusiasm and comprehensive development of ride-hailing market.
